MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 11 April 1996 at 6.30 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, Provost Mrs FRANCES E DUNCAN, Councillors WALLIE LEASK, WILLIAM MIDDLETON, BRIAN MILNE and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors ALEX KING and ALEX SHAND.

1. BUILDING WARRANTS

There was submitted and noted Report No 218/96 by the Director of Planning, Transport and Economic Development detailing Building Warrants recently issued.

2. PLANNING APPLICATIONS

There was submitted Report No 201/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

Delegated Approvals

(i) To note consents issued by the Director of Planning, Transport and Economic Development in respect of the applications shown in List A of the report.

Recommended Refusals

(ii) Unless otherwise shown, to refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the report and appended to this minute.

Recommended Approvals

(iii) To grant consent subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, additional conditions approved by the Committee in respect of the applications detailed in List C of the report and appended to this minute.

3. PUBLIC INQUIRY INTO THE REFUSAL OF OUTLINE PLANNING PERMISSION FOR

RESIDENTIAL DEVELOPMENT AT WELLBANK, DUNDEE

There was submitted Report No 155/96 by the Director of Planning, Transport and Economic Development advising that Angus Council had inherited the decision of the City of Dundee District Council to refuse outline planning consent for residential development on land to the south of Mattock Road/School Road, Wellbank, Dundee. The decision had been appealed and would be the subject of a Public Inquiry.

After Councillor Ellis had asked, and received answers to, a number of questions, the Committee agreed:-

(i) to accept the decision of the City of Dundee District Council to refuse planning application No D20391; and

(ii) to authorise officers of Angus Council to participate in the Public Inquiry.

4. ENFORCEMENT ACTION - 44 JOHN STREET, ARBROATH

There was submitted Report No 198/96 by the Director of Planning, Transport and Economic Development recommending enforcement action to secure the removal of a satellite antenna from the property at 44 John Street, Arbroath which was located within the Central Conservation Area.

The Committee agreed that enforcement action be taken.

5. PLANNING APPEAL DECISION - 81/83 BRIDGE STREET, MONTROSE

There was submitted Report No 199/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against four conditions imposed by Angus District Council on a change of use of the premises at 81/83 Bridge Street, Montrose.

After noting the Reporter’s findings with regret, the Committee agreed that the premises be monitored, especially with regard to storage of goods outwith the premises, and any obstruction of the footpath be reported to the Police.

6. CONSERVATION GRANT - 3 THE SHORE, ARBROATH

There was submitted Report No 200/96 by the Director of Planning, Transport and Economic Development on an application for a conservation grant for the installation of replacement windows at 3 The Shore, Arbroath.

The Committee approved a grant of £822.81 subject to the seven conditions set out in the Report.
