MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 23 May 1996 at 6.30 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, Provost Mrs FRANCES E DUNCAN, Councillors FRANK ELLIS, ALEX KING, GEORGE LAMONT, WALLIE LEASK, WILLIAM MIDDLETON, BRIAN MILNE, SANDY WEST and THOMAS I N YOUNG.

Apology: An apology for absence was intimated on behalf of Councillor ALEX SHAND.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of the Committee held on 11 April and 2 April 1996 were submitted and approved as a correct record and signed by the Convener.

2. EXECUTIVE SUB-COMMITTEE

With reference to Standing Order 32(3) the Committee appointed Councillors Mrs Ritchie (Convener), Mowatt (Vice-Convener) and Young to the Executive Sub-Committee.

3. BUILDING WARRANTS

There was submitted and noted Report No 381/96 by the Director of Planning, Transport and Economic Development detailing Building Warrants recently issued.

4. PLANNING APPLICATIONS

There was submitted Report No 380/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Deferred Applications

To defer consideration of application 01/96/0248 by Craig Rally Karting for the formation of an all-weather track for rally karting to enable the Director of Planning, Transport and Economic Development to undertake further investigations.

(v) Debated Applications

Interest in the following application was declared by Councillors Ritchie and West as Council appointees to Dorward House.

(a) The Committee considered Application No 01/96/0249 by Montrose Tennis Club for the erection of floodlights at Dorward Place/Warrack Terrace, Montrose as detailed in Report No 380/96 by the Director of Planning, Transport and Economic Development who recommended conditional approval.

The Committee then heard local objectors to the application following which Councillor Ritchie, seconded by Councillor West, moved that the application be refused on the following grounds:-

"That the proposed development would conflict with the dignified quality and be injurious to the character of an outstanding conservation area"; and

"That the proposal, if approved, would be detrimental to the amenity currently enjoyed by the adjacent residents."

The Committee agreed that the application be refused.

(b) The Committee considered Application No D21294 by Discovery Plastics for retrospective consent for change of use from vacant buildings at Inveraldie Farm, Tealing to buildings for the production and storage of recycled plastics and polythene as detailed in Report No 380/96 by the Director of Planning, Transport and Economic Development who recommended conditional approval.

Councillor Ellis, the local member, expressed concern at the management of the area and, seconded by Councillor Leask, moved that the application be refused.

COUNCILLOR WEST, SECONDED BY COUNCILLOR MOWATT, MOVED AS AN AMENDMENT THAT THE APPLICATION BE CONDITIONALLY APPROVED.

On a vote being taken, the members voted:-

for the motion:-

Councillors Doig, Ellis and Leask (3);

for the amendment:-

Councillors Ritchie, Mowatt, Provost Duncan, King, G Lamont, W Middleton, Depute Provost Milne, West and Young (9).

The amendment was declared carried and became the finding of the meeting resulting in the application being approved subject to the conditions detailed in the Director’s Report. The Committee also agreed that the Director of Planning, Transport and Economic Development monitor the operation for three months.

5. PLANNING APPEAL DECISIONS

(i) 45 Kemsley Place, Forfar

There was submitted Report No 351/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against refusal by Angus District Council to grant consent for the erection of a conservatory at 45 Kemsley Place, Forfar.

The Committee noted that the Secretary of State had dismissed the appeal.

(ii) East Hill Road, Kirriemuir

There was submitted Report No 348/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against refusal by Angus District Council to grant consent for a housing development at East Hill Road, Kirriemuir.

The Committee noted that the Secretary of State had upheld the appeal and granted outline planning permission for the development.

(iii) Marykirk Road, Hillside, Montrose

There was submitted Report No 350/96 by the Director of Planning, Transport and Economic Development on the findings of the Reporter appointed by the Secretary of State to determine an appeal against the refusal by Angus District Council to grant consent for a housing development at Marykirk Road, Hillside.

The Committee noted that the Secretary of State had upheld the appeal.

(iv) 5 Linross Farm, Glamis

There was submitted Report No 352/96 by the Director of Planning, Transport and Economic Development on the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal by Angus District Council to grant retrospective planning consent for the erection of a conservatory at 5 Linross Farm, Glamis.

The Committee noted that the Secretary of State had dismissed the appeal and therefore that enforcement action would be required to remove the conservatory.

The Convener then expressed concern at such action being required and urged members of the public to consult with the Planning Department and obtain planning consent, if required, before any building work commenced.

The Committee noted the position.

(v) 1 Benzil Cottages, by Forfar

There was submitted Report No 349/96 by the Director of Planning, Transport and Economic Development on the findings of the Reporter appointed by the Secretary of State to determine an appeal against the refusal by Angus District Council to grant consent for the erection of a workshop at 1 Benzil Cottage near Forfar.

The Committee noted that the appeal had been upheld.

6. ENFORCEMENT ACTION

(i) Craigo Village

There was submitted Report No 307/96 by the Director of Planning, Transport and Economic Development seeking authority to take enforcement action in relation to the storage of a quantity of wood, old cars and a trailer and its contents on an area of ground within the village of Craigo, Angus.

The Committee noted that an effort had been made to clear up the area but agreed that, should the area remain uncleared, enforcement action be taken.

(ii) Pitempton House, Strathmartine

There was submitted Report No 382/96 by the Director of Planning, Transport and Economic Development seeking authority to commence enforcement action in respect of a change of use of land at Pitempton Farm, Pitempton Road, Strathmartine, by Dundee, from use as a dairy farm to use as a storage area for builders materials and associated impedimenta.

After noting the circumstances of the case, the Committee agreed that enforcement action be taken.

7. CONSERVATION GRANT -

(i) 53 John Street, Montrose

There was submitted Report No 340/96 by the Director of Planning, Transport and Economic Development on an application for a grant towards the cost of replacing a traditional canted bay dormer window in a Category B listed building at 53 John Street, Montrose.

The Committee approved a conservation grant of £690.50, subject to the seven conditions set out in the Report.

(ii) 111/113 Bridge Street, Montrose

There was submitted Report No 341/96 by the Director of Planning, Transport and Economic Development on an application for a grant towards the replacement of traditional style windows in a Category B listed building at 111/113 Bridge Street, Montrose.

The Committee approved a conservation grant of £852.18, subject to the six conditions set out in the Report.

8. POLICY GUIDANCE FOR DEVELOPMENT CONTROL

There was submitted Report No 391/96 by the Director of Planning, Transport and Economic Development seeking the adoption of various planning policies adopted by Tayside Regional Council and Angus District Council to guide the development control process over the initial period of the Council administration.

The Committee agreed to adopt the land use policies set out in the Report until such time that they were reviewed and/or replaced by Angus Council.
