MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 26 September 1996 at 6.30 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, WILLIAM DOIG, FRANK ELLIS, ALEX KING, WALLIE LEASK, WILLIAM MIDDLETON, BRIAN MILNE and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors STEWART MOWATT, IAN HUDGHTON, Mrs RENATE LAMONT, ALEX SHAND and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Commitee held on 15 August 1996 and 5 September 1996 were submitted and approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

It was reported and noted that between 26 August and 13 September, 65 Building Warrants had been approved and nine warrants amended with total value of the work amounting to some £1,539,768.

3. PLANNING APPLICATIONS

There was submitted Report No 794/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

4. REFERRED APPLICATIONS - CONDITIONS

(i) Application No 01/96/1255 & 02/96/1020 - Old Toll House, Clocksbriggs, Forfar

With reference to Article 1(6)(a) of the minute of meeting of Angus Council held on 19 September 1996 when it was agreed that the proposed extension to the Old Toll House, Clocksbriggs, Forfar be approved, with the conditions being agreed by the Development Control Committee, the Committee agreed that the submitted plans were acceptable and accordingly no additional conditions were necessary.

(ii) Application No 01/96/1096 - 25 Holding, Murroes

With reference to Article 1(6) of the minute of meeting of Angus Council held on 19 September 1996 when the Council agreed that outline planning permission be granted for a dwellinghouse on the site of the old quarry, 25 Holding, Murroes, Kingennie, the Committee agreed that the undernoted conditions be attached to the consent:-

1. That the approval of the details of the siting, size, height, design and external appearance of the building and a means of access thereto shall be obtained from the planning authority before any development is commenced.

2. That the disposal of sewage effluent be in accordance with the standards required by both the Building Control Authority and the Scottish Environmental Protection Agency.

3. That notwithstanding the details to be submitted under Condition 1 above, vehicle access to the site shall be via the existing field access which shall be upgraded to conform with the standards required by the Director of Roads, to the satisfaction of the planning authority prior to the occupation of the dwellinghouse.

4. That nowithstanding the details to be submitted under Condition 1 above, a turning space shall be provided within the site curtilage to enable vehicles to enter and leave in a forward gear.

It was further agreed that prior to the issue of the consent, a Section 50 Agreement be entered into, to ensure that no other dwellings are built on the southern road frontage of the B961 between the application site and 25 Holding.

(iii) Application No 01/96/1409 - West Port Bar, Keptie Street, Arbroath

With reference to Article 1(17) of the minute of meeting of Angus Council held on 19 September 1996 when approval was given for the change of use and conversion of attic to form three flats at West Port Bar, Keptie Street, Arbroath, subject to any additional conditions being agreed by the Development Control Committee, the Committee agreed that the undernoted additional condition be attached to the consent:-

"That a scheme of soundproofing be undertaken and details submitted for the written approval of the Director of Planning, Transport and Economic Development prior to any work commencing on the proposed alteration to the building."

5. PLANNING APPEAL DECISIONS

(i) Farm Park, Letham Grange

There was submitted Report No 788/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal to the Reporter appointed by the Secretary of State to determine the appeal against the conditions imposed on the granting of planning permission by Angus District Council for the change of use and alterations to form bedroom accommodation for hotel use at Farm Park, Letham Grange, by Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

(ii) Chanonry Wynd, Brechin

There was submitted Report No 789/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus District Council to grant consent for the erection of a dwellinghouse at Chanonry Wynd, Brechin.

The Committee noted that the Secretary of State had dismissed the appeal.

(iii) Advertisement Consent - Newtyle

There was submitted Report No 786/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus District Council to grant advertisement consent for a sign on land adjacent to the B954, Newtyle, Angus.

The Committee noted that the Secretary of State had dismissed the appeal.

(iv) The Garage, North Grimsby, Arbroath

There was submitted Report No 786/96 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus District Council to grant advertisement consent at The Garage, North Grimsby, Arbroath and the appeal against the Enforcement Notice instigated by the Council.

The Committee noted that the Secretary of State had dismissed both appeals.

6. SCOTTISH OFFICE QUALITY INITIATIVES FOR SCOTTISH PLANNING SYSTEM

There was submitted Report No 795/96 by the Director of Planning, Transport and Economic Development on the recently announced Scottish Office Quality Initiatives for the Scottish Planning System from which it was noted that the Scottish Office intended setting new targets for dealing with planning applications, an audit unit to improve performance and the development of local planning charters to highlight best practice.

During discussion on the Report, whilst supportive of any measures to improve the service to the public, the Committee was of the view that the proposed package was ill-conceived and would not be an accurate reflection of the quality of service provided. It was noted that in many sensitive applications, considerable discussion took place with the applicant to achieve satisfactory proposals and on time based targets there might be a significant increase in refusals and consequential appeals, which would cause a considerable increase in staff time. It was felt that the unrealistic targets would lead to shorter consultation time and an adverse effect on the quality of service provided and ultimately lead to a requirement for additional staff.

The Committee accordingly noted the terms of the Report, with these reservations.
