MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 5 December 1996 at 6.30 pm.

Present: Councillors STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, IAN HUDGHTON, ALEX KING, Mrs RENATE LAMONT, GLENNIS MIDDLETON, WILLIAM MIDDLETON, BRIAN MILNE, ALEXANDER SHAND, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillor Mrs KATHLEEN RITCHIE

Councillor STEWART MOWATT, Vice Convener, in the Chair.

1. BUILDING WARRANTS

It was reported and noted that between 4 November and 22 November 1996, 66 Building Warrants had been approved and 4 warrants amended with the total value of the work amounting to £864,556.

2. PLANNING APPLICATIONS

There was submitted Report No 1064/96 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

After noting that application No 01/96/1629 had been withdrawn, to refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

- 3. FARM PARK, LETHAM GRANGE - AMENDMENT TO CONDITION

There was submitted Report No 1045/96 by the Director of Planning, Transport and Economic Development seeking to amend a condition imposed by the Committee on 13 June 1996 relating to the conversion of the red brick administration block to hotel bedroom accommodation. The Report gave a brief history of the application and the existing condition that recommended that the developer’s proposal to seal and paint the building, as an alternative to harling it, should be accepted, with the proviso that the work be carried out no later than 31 March 1997.

Councillor Milne, seconded by Councillor King, moved that the existing condition that the developer harl the building, remain in place.

COUNCILLOR HUDGHTON, SECONDED BY COUNCILLOR YOUNG, MOVED AS AN AMENDMENT THAT CONSIDERATION BE DEFERRED TO THE NEXT MEETING TO ALLOW OFFICIALS TO BRING FORWARD A MORE DETAILED REPORT ON THE HISTORY OF THE APPLICATION AND THE OPTIONS AVAILABLE TO THE AUTHORITY.

On a vote being taken, the members voted:-

For the motion:-

Councillors Ellis, King, Milne and Shand (4).

For the amendment:-

Councillor Mowatt, Doig, King, Leask, Middleton, West and Young (7).

The amendment was declared carried and became the finding of the meeting resulting in the matter being deferred to the next meeting.

4. ENFORCEMENT ACTION

(a) Elliot Industrial Estate, Arbroath

There was submitted Report 1046/96 by the Director of Planning, Transport and Economic Development detailing the circumstances surrounding the operation of a clinical waste facility at Elliot Industrial Estate, Arbroath.

The Committee agreed not to take enforcement action in respect of the technical breach of planning consent and to inform the operator, Scotsafe, that the Council would accept the processing of Category A clinical waste, excluding human anatomical parts, animal carcasses and radioactive/chemical waste.

(b) Lodge Cottage, Glenisla House, Glen Isla

There was submitted Report 1044/96 by the Director of Planning, Transport and Economic Development detailing the history and circumstances surrounding a breach of planning consent in respect of a rear extension at Lodge Cottage, Glenisla House, Glen Isla.

The Committee agreed that no enforcement action be taken.

5. GOOD PRACTICE GUIDELINES

There was submitted Report 1053/96 by the Directors of Law and Administration and Planning, Transport and Economic Development recommending that the Council adopt Good Practice Guidelines for members of the Development Control Committee and the Council in dealing with planning applications.

The Committee agreed that the matter be continued for further consideration.

6. LETHAM DRAINAGE EMBARGO

There was submitted Report No 1065/96 by the Director of Planning, Transport and Economic Development advising that meetings had been held with NOSWA representatives as a result of which it was proposed that an immediate embargo be placed on future developments at Letham, in view of drainage problems.

The Report noted that there were three "live" applications currently being processed within the Planning Department (totalling 21 houses) and, after discussion with NOSWA, these developments would be accepted if approved by the Council. However, no further applications would be entertained by the planning authority after 6 December 1996.

The Committee thereafter agreed:-

(i) that a development embargo be imposed on the village of Letham;

(ii) in conjunction with NOSWA, that details of a scheme providing guidelines be submitted to the next meeting of the Committee; and

(iii) that the embargo be reviewed in two years’ time.
