MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 10 April 1997 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, Mrs RENATE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors FRANK ELLIS, ALEX KING, IAN HUDGHTON and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 20 February and 13 March 1997 were submitted, approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

It was reported and noted that between 3 March and 28 March 1997, 122 Building Warrants had been approved and 21 Warrants amended with the total value of work amounting to £4,343,804.

3. PLANNING APPLICATIONS

There was submitted Report No 392/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

4. ADVERTISING IN THE COUNTRYSIDE - REVIEW OF POLICY

With reference to Article 3 of the minute of meeting of this Committee held on 24 October 1996, there was submitted Report No 390/97 by the Director of Planning, Transport and Economic Development recommending the adoption of a revised policy on signing/advertising in the countryside following adoption of the revised Tourist Signposting Policy.

The Committee agreed to adopt the revised policies as detailed in the Report, which would be incorporated in a re-printed Advice Note 7.

5. TREE PRESERVATION ORDER 1997 - NO 1 FYFE-JAMIESON MATERNITY HOME, TAYLOR STREET, FORFAR

There was submitted Report No 391/97 by the Director of Planning, Transport and Economic Development advising that Provisional Tree Preservation Order 1997 No 1 had come into effect on 19 February 1997.

Having noted the terms of an objection and the Director’s comments thereon, the Committee agreed to recommend that the Order be now confirmed.

6. PLANNING APPEAL DECISIONS

(a) 89 High Street, Brechin

There was submitted Report No 365/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the use of premises at 89 High Street, Brechin for a hot food takeaway.

The Committee noted that the Secretary of State had upheld the appeal.

(b) Kinnaber Road, Hillside

There was submitted Report No 363/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a dwellinghouse at Kinnaber Road, Hillside, Montrose.

The Committee noted that the Secretary of State had dismissed the appeal.

(c) The Dovecot, Mains of Fowlis

There was submitted Report No 364/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the conversion of a dovecot to form a dwellinghouse at Mains of Fowlis, by Dundee.

The Committee noted that the Secretary of State had dismissed the appeal.

7. ANGUS COUNCIL - THE FIRST YEAR

With reference to Article 3(b)(iii) of the minute of meeting of Angus Council held on 27 March 1996, the Committee noted for its interest Report No 360/97 by the Chief Executive on Angus Council - The First Year.
