MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 13 November 1997 at 6.00 pm.

Present: Councillors MRS KATHLEEN RITCHIE, STEWART MOWATT, FRANK ELLIS, ALEX KING, BRIAN MILNE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG. Also present Councillor Mrs GLENNIS MIDDLETON.

Apologies: Apologies for absence were intimated on behalf of Councillors WILLIAM DOIG, MRS RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON and DAVID SELFRIDGE.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 2 and 23 October 1997 were accepted as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 13 October to 31 October 1997 a total of 82 Building Warrants and 16 amendments to warrants had been approved with the estimated total value of the work amounting to £1,969,801.

3. PLANNING APPLICATIONS

There was submitted Report No 1167/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in list B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Deferred Application

To defer consideration of Application No 01/97/1925 by A Forsyth for the erection of 3 terraced dwellings plus integral garages at 1 Bents Road, Montrose to allow the Convener to meet with the Roads Department to discuss the road safety aspect.

4. PLANNING APPEAL DECISIONS

(a) Drumachlie Loan, Brechin

There was submitted Report No 1162/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a house at Drumachlie Farm, Drumachlie Loan, Brechin.

The Committee noted that the Secretary of State had dismissed the appeal.

(b) Oathlaw Parish Church, Angus

There was submitted Report No 1163/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the conversion of Oathlaw Parish Church building to a Silversmith Workshop, Showroom and Flat, together with development of adjacent ground for car parking and landscaping.

The Committee noted that the Secretary of State had dismissed the appeal.

5. ENFORCEMENT ACTION

(a) Chaplin’s Bar, 16 West Port, Arbroath

There was submitted Report No 1164/97 by the Director of Planning, Transport and Economic Development which detailed a decision made by the Arbroath Procurator Fiscal not to prosecute owner of Chaplin’s Bar, Arbroath over a failure to comply with an Enforcement Notice which required the removal of two unauthorised illuminated advertising signs. The Report also outlined the scope for further action available to the Council.

The Committee agreed that the Director of Planning, Transport and Economic Development make arrangements for the removal of the two unauthorised signs and, in conjunction with the Director of Law and Administration, recover costs incurred from the owner.

(b) 20 Strangs Ley, Forfar

There was submitted Report No 1166/97 by the Director of Planning, Transport and Economic Development detailing the circumstances surrounding an alleged breach of condition in respect of planning permission for the erection of a boundary fence at 20 Strangs Ley, Forfar.

After hearing the objector, the Committee agreed that the altered position of the boundary fence did not constitute a significant departure from planning permission reference 01/97/1339 and, as such, no additional planning application was required and enforcement action was inappropriate.
