ANGUS COUNCIL

MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 13 March 1997 at 7.20 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors IAN HUDGHTON and WALLIE LEASK.

Councillor Mrs RITCHIE, Convener, in the Chair.

1. BUILDING WARRANTS

It was reported and noted that between 10 February and 28 February 1997, 72 Building Warrants had been approved and 7 Warrants amended with the total value of work amounting to £1,064,923.

2. PLANNING APPLICATIONS

There was submitted Report No 341/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

- (iv)Debated Application

With reference to Article 3 (iv) of the minute of meeting of the Development Control Committee of 20 February 1997, the Committee considered Report No 339/97 by the Director of Planning, Transport and Economic Development regarding Application No 01/96/1755 by Torlea Woodlands Ltd for the erection of a dwellinghouse and garage at No 12 Holding, Upper Todd Hills, Tealing.

COUNCILLOR MRS RITCHIE, SECONDED BY COUNCILLOR MOWATT MOVED THAT THE APPLICATION BE REFUSED FOR THE REASONS DETAILED IN REPORT NO 144/97.

Councillor King seconded by Councillor Ellis, moved as an amendment that the application be approved subject to the conditions detailed in Report No 339/97.

On a vote being taken, the members voted:-

For the motion:-

Councillors Mrs Ritchie, Mowatt, Doig, Mrs Lamont, West and Young (6)

For the amendment:-

Councillors Ellis, King, Middleton, Milne and Shand (5)

The motion was declared carried and became the finding of the meeting resulting in the application being refused.

3. PLANNING APPEAL DECISIONS

(a) Westmill of Colliston, by Arbroath

There was submitted Report No 311/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the change of use of a storage building to a workshop at Westmill of Colliston, by Arbroath.

The Committee noted that the Secretary of State had upheld the appeal.

(b) Old Whisky Road, Auchterhouse

There was submitted Report No 312/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of two dwellinghouses at Old Whisky Road, Auchterhouse.

The Committee noted that the Secretary of State had dismissed the appeal.

(c) Whinnydrum, Fordmouth, Aberlemno

There was submitted Report No 313/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a dwellinghouse at Whinnydrum, Fordmouth near Aberlemno.

The Committee noted that the Secretary of State had dismissed the appeal.

(d) 2 Lowson Avenue, Carnoustie

There was submitted Report No 314/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by the former Angus District Council to grant consent for the erection of a conservatory at 2 Lowson Avenue, Carnoustie.

The Committee noted that the Secretary of State had dismissed the appeal.

4. CARNOUSTIE DRAINAGE EMBARGO - REVISION OF CONDITIONS

There was submitted Report No 340/97 by the Director of Planning, Transport and Economic Development detailing revised terms and conditions in respect of the drainage embargo placed on Carnoustie at the request of the North of Scotland Water Authority (NoSWA).

The Committee agreed to adopt the guidelines suggested by NoSWA as a basis for dealing with planning applications in Carnoustie.

5. ENFORCEMENT ACTION - DOUGLASTOWN, BY FORFAR

There was submitted Report No 330/97 by the Director of Planning, Transport and Economic Development detailing the circumstances relative to a recommendation to implement enforcement action in respect of various breaches of planning legislation and non-compliance with a determined enforcement action by Messrs R S Hill, Joiners and Building Contractors, Douglastown, Forfar. A summary of the case history was included in the Report.

The agent for Mr Hill was present and advised that Mr Hill had submitted an application to the Planning Department seeking consent to continue to use the land for the storage of building materials.

The Committee noted the long and complex history relating to Messrs R S Hill and agreed that enforcement action be authorised:-

(i) against a setting down/storage area created without the benefit of planning permission;

(ii) in respect of a change of use on a dwellinghouse from that of domestic to that of storage; and

(iii) in respect of the storage of any material remaining on land across the A94 after 1 June 1997.

6. DUNDEE DISTRICT LOCAL PLAN - PUBLIC LOCAL INQUIRY FINDINGS

With reference to Article 2 of the minute of meeting of the Planning and Transport Policy Committee held on 6 March 1997, there was submitted Report No 336/97 by the Director of Planning, Transport and Economic Development briefly summarising the findings and recommendations directly relative to Angus from the Report of the Public Local Inquiry into objections to the finalised Dundee District Local Plan.

The Committee noted the contents of the Report and agreed that the Finalised Local Plan, taken together with the Reporter's recommendation, be treated as a material consideration in assessing and determining planning applications arising in this area in advance of the preparation and adoption of the Angus Local Plan.
