MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 2 October 1997 at 6.00 pm.

Present: Councillors MRS KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, MRS RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG. Also present Councillors BILL CROWE, IAN MACKINTOSH and ROB MURRAY.

Councillor MRS RITCHIE, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 25 August to 19 September 1997 a total of 121 Building Warrants had been approved and 17 warrants amended with the estimated total value of the work amounting to £4,415,632.

2. PLANNING APPLICATIONS

There was submitted Report No 991/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

After noting that application No 01/97/1538 by J & J Learmonth, Kirriemuir had been withdrawn, to refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Deferred Application

The Committee considered application No 01/97/1566 for the erection of 34 dwellinghouses by Bett Homes Ltd at Dick Street, Monifieth as detailed in Report No 991/97 (List C) by the Director of Planning, Transport and Economic Development who recommended conditional approval.

An objector was present and addressed the Committee, expressing concern at the amendments to the application presented that night and at the parking problems in the area.

Various members were heard on the matter including Monifieth Councillors Murray and McGlynn, and it was agreed to defer consideration of the application to the next meeting to allow Betts, the objectors and the Director of Planning, Transport and Economic Development to consider ways of addressing the road safety concerns associated with the development.

(v) Debated Application

The Committee considered application No 01/97/1714 by Messrs Roland Micky and Grunt for the erection of four detached dwellinghouses at The Westway, Hospitalfield, Arbroath as detailed in Report 991/97 (List C) by the Director of Planning, Transport and Economic Development who recommended conditional approval.

Slides were shown and Councillor King moved refusal of the application on the grounds of overintensification, but failed to find a seconder.

The Committee agreed that the application be conditionally approved, as detailed in the Report.

3. PLANNING APPEAL DECISIONS

(a) The Ark Pets Hotel, Woodville, by Arbroath

There was submitted Report No 988/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of a house at Ark Pets Hotel, Woodville, by Arbroath.

The Committee noted that the Secretary of State had upheld the appeal.

(b) Land at East Mill, Kirkton, Glenisla

There was submitted Report No 990/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of Angus Council to grant consent for the erection of five houses on land at East Mill, Kirkton of Glenisla.

The Committee noted that the Secretary of State had dismissed the appeal.

(c) Enforcement Appeal Decision - Deneside, Douglastown, by Forfar

There was submitted Report No 989/97 by the Director of Planning, Transport and Economic Development on the findings of the Reporter appointed by the Secretary of State to determine the appeal against the enforcement action served by Angus Council for the removal of unauthorised storage and building materials, etc at land at Deneside, Douglastown, by Forfar.

The Committee noted the Secretary of State had dismissed the appeal.

4. CONSERVATION GRANT APPLICATION

There was submitted Report No 984/97 by the Director of Planning, Transport and Economic Development detailing the reasons for his decision to refuse financial assistance from the conservation grant budget towards the re-roofing works at Kirk House Barn, Ruthven, Angus.

Slides were shown and the applicant addressed the Committee.

COUNCILLOR RITCHIE, SECONDED BY COUNCILLOR MOWATT, MOVED THAT A GRANT OF £1,000 BE AWARDED.

Councillor King, seconded by Councillor Middleton, moved that a grant of £3,000 be awarded.

On a vote being taken, the members voted:-

For the motion:

Councillors RITCHIE, MOWATT, ELLIS, Mrs LAMONT, McGLYNN, SHAND and WEST (7).

For the amendment:

Councillors DOIG, KING, MIDDLETON, MILNE and YOUNG (5).

Accordingly, the motion was declared carried resulting in a grant of £1,000 being awarded.
