MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 30 January 1997 at 6.30 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, BRIAN MILNE, and THOMAS I N YOUNG.

Apologies Apologies for absence were intimated on behalf of Councillors IAN HUDGHTON, WALLIE LEASK, WILLIAM MIDDLETON, ALEX SHAND and SANDY WEST.

Councillor Mrs RITCHIE, Convener, in the Chair.

1. BUILDING WARRANTS

It was reported and noted that between 23 December 1996 and 17 January 1997, 66 Building Warrants had been approved and 7 Warrants amended with the total value of work amounting to £4,134,850.

2. PLANNING APPLICATIONS

There was submitted Report No 171/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

After noting that application No 01/96/1801 had been withdrawn, to refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Recommended Approvals

After noting that application No 01/96/1760 had been withdrawn, to grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Debated Applications

- The Committee considered Application No 01/96/1825 by Mr and Mrs J Webster, for outline consent for the erection of a dwellinghouse at Magungie House, Arbroath as detailed in Report No 171/97 (List B) by the Director of Planning, Transport and Economic Development who recommended refusal for reasons detailed in the Report.

An agent for the applicant was present and addressed the Committee.

Councillor Milne, seconded by Councillor King, moved that the application be conditionally approved.

COUNCILLOR Mrs RITCHIE, SECONDED BY COUNCILLOR MOWATT, MOVED AS AN AMENDMENT THAT THE APPLICATION BE REFUSED.

On a vote being taken, the members voted:-

For the motion:-

Councillors Ellis, King, Milne and Young (4).

For the amendment:-

Councillors Mrs Ritchie, Mowatt, Doig and Mrs Lamont (4).

There being an equality of votes, the Convener exercised her casting vote in favour of the amendment, resulting in the application being refused.

3. PLANNING APPEAL DECISIONS - SCHOOL ROAD/MATTOCKS ROAD, WELLBANK

There was submitted Report No 150/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal of the former Dundee District Council to grant consent for the erection of houses at School Road/Mattocks Road, Wellbank.

The Committee agreed:-

(i) that the Secretary of State's decision to uphold the appeal be noted; and

(ii) that a Section 50 Agreement be formulated to restrict the development to low cost housing only.

4. CHILDREN’S PLAY CENTRE, DRONLEY ROAD, BIRKHILL

There was submitted Report No 167/97 by the Director of Planning, Transport and Economic Development on complaints received regarding hours of operation of the children’s play centre, Dronley Road, Birkhill.

The Committee agreed to defer consideration of this matter as a planning application to regulate the hours had recently been lodged.
