MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 9 January 1997 at 6.35 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, BRIAN MILNE, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors IAN HUDGHTON, WALLIE LEASK, BILL MIDDLETON and ALEX SHAND.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 14 November and 5 December 1996 were submitted, approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

It was reported and noted that between 25 November and 20 December 1996, 74 Building Warrants had been approved and 9 warrants amended with the total value of the work amounting to £3,425,976.

3. PLANNING APPLICATIONS

There was submitted Report No 38/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

After noting that application No 01/96/1703 had been withdrawn, to refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List B of the Report and the appendix to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development, in respect of the applications detailed in List C of the Report and the appendix to this minute.

4. ENFORCEMENT ACTION - SMALL HOLDING, MEMUS VILLAGE

There was submitted Report No 31/97 by the Director of Planning, Transport and Economic Development explaining the reasons for not recommending the service of a Wasteland Notice in respect of the condition of the small holding occupied by Miss Betsy MacIntosh in the village of Memus.

The Committee noted the long and complex history relating to the small holding at Memus and, after hearing the Convener, agreed not to serve a Wasteland Notice but to continue to monitor the site, over the next 12 months, in an attempt to achieve a general tidying up of the area.

5. RESIDENTIAL DEVELOPMENT AT ARBROATH ROAD, DUNDEE - CONSULTATION

There was submitted Report No 32/97 by the Director of Planning, Transport and Economic Development advising that the Council had received a consultation document from Dundee City Council regarding two planning applications for residential development at Arbroath Road, Dundee by Wimpey Homes and Tulloch Homes.

The Committee was advised that Dundee City Council had granted the applications the previous day and therefore agreed Dundee City Council be advised that:-

(i) planning consent should be subject to a Section 50 or other appropriate legal agreement to provide for a pedestrian route from West Grange Road to the existing footway north of Palnackie Road junction at the applicant’s expense prior to the occupation of any dwelling;

(ii) a condition of the planning consent should be that a suitable corridor be reserved to provide for the dualling of the A92 and the provision of suitable landscaping; and

(iii) prior to the commencement of any development, a scheme for surface and foul water management should be submitted to and approved by Dundee City Council.

- 6. FARM PARK, LETHAM GRANGE

There was submitted Report No 30/97 by the Director of Planning, Transport and Economic Development detailing information in relation to a development at Farm Park, Letham Grange.

Councillor Milne, seconded by Councillor King, moved suspension of Standing Order 13(1) to allow a resident of Letham Grange to address the Committee.

Councillor Ritchie, seconded by Councillor Mowatt, moved as an amendment that the application be deferred to the next meeting to allow the owners of the residential block to be present.

On a vote being taken, the members voted:-

For the motion -

Councillors Doig, Ellis, King, Milne and Young (5).

For the amendment -

Councillors Ritchie, Mowatt, Mrs Lamont and West (4).

The motion was declared carried and become the finding of the meeting.

Mr Thomson a local resident was then invited to address the Committee. Slides were shown.

COUNCILLOR MILNE, SECONDED BY COUNCILLOR KING, MOVED THAT THE BUILDING BE HARLED IN ACCORDANCE WITH THE SECRETARY OF STATE’S FINDINGS.

Councillor Ritchie, seconded by Councillor Mowatt, moved as an amendment that, in relation to Condition 6, the applicant be advised of the requirement that the wall be harled or, as a compromise, a masonry paint applied to the satisfaction of the Director.

On a vote being taken, the members voted:-

For the motion -

Councillors Doig, Ellis, King, Milne and Young (5).

For the amendment -

Councillors Ritchie, Mowatt, Mrs Lamont and West (4).

The motion was declared carried and became the finding of the meeting resulting in the harling condition requiring to be complied with.

7. DISCOVERY PLASTICS, INVERALDIE FARM, TEALING

With reference to Article 7 of the minute of meeting of this Committee held on 5 September 1996, there was submitted Report No 35/97 by the Director of Planning, Transport and Economic Development detailing progress made to meet the conditions imposed on the temporary planning permission granted in respect of a change of use from vacant buildings to production and storage of recycled plastics and polythene at Inveraldie Farm, Tealing.

The Committee noted the progress made to date and asked the Director of Planning, Transport and Economic Development to continue to monitor the position.

8. PLANNING APPEALS

(a) Denfield Road, Woodville, by Arbroath

There was submitted Report No 34/97 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a house at Denfield Road, Woodville, by Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

(b) Marykirk Road, Hillside, Montrose - Award of Expenses

With reference to Article 5(3) of the minute of meeting of this Committee held on 2 May 1996, there was submitted Report No 35/97 by the Director of Planning, Transport and Economic Development advising that a claim for expenses lodged by the agents for Stewart Milne, the successful appellants in an appeal at Marykirk Road, Hillside, had been upheld.

The Committee agreed, reluctantly, to pay £5,049.60 (excluding VAT) to Halliday Fraser Munro Planning in payment of their successful claim for award of expenses.

9. TREE PRESERVATION ORDER 1996 NO 1 NORTH CRAIGO BY MONTROSE

There was submitted Report No 12/97 by the Director of Planning, Transport and Economic Development advising that Tree Preservation Order 1996 No 1 came into effect on 22 October 1996.

The Committee agreed that the Order be now confirmed.

10. LETHAM DRAINAGE EMBARGO

With reference to Article 6 of the minute of meeting of this Committee held on 5 December 1996, there was submitted Report No 36/97 by the Director of Planning, Transport and Economic Development detailing the terms and conditions in respect of a drainage embargo placed on Letham village by the North of Scotland Water Authority.

The Committee agreed to adopt the guidelines suggested by NOSWA as a basis for dealing with planning applications in Letham over the next two years, after which the situation would be reviewed.

11. WASTE DISPOSAL FACILITY AT CUNMONT QUARRY, NEWBIGGING

There was submitted Report No 39/97 by the Director of Planning, Transport and Economic Development seeking the Committee’s approval to co-fund (possibly in partnership with SEPA) the appointment of consultants to assess certain technical aspects of a planning application to infill the former Cunmont Quarry, Newbigging.

The Committee welcomed the proposed appointment and authorised expenditure of up to £5,000 to engage consultants to assist in the examination of planning application 01/96/1407 for the infilling of Cunmont Quarry, the terms of the consultants' brief to be delegated to the Director of Planning, Transport and Economic Development.
