MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Tuesday, 9 September 1997 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

1. BUILDING WARRANTS

It was reported and noted that in the period 4th-22nd August 1997, a total of 75 Building Warrants had been approved, 5 Demolition Warrants issued and 5 Warrants amended with the total value of the work amounting to £3,038,000.

2. PLANNING APPLICATIONS

There was submitted Report No 942/97 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To note that application Nos 01/95/1870 and 02/95/1085 had been withdrawn.

(iii) Recommended Approvals

After hearing an objector, to defer consideration of application No 01/97/1568, and, to grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

3. ENFORCEMENT ACTION - ORCHARDBANK INDUSTRIAL ESTATE

There was submitted Report No 945/97 by the Director of Planning, Transport and Economic Development recommending initiation of enforcement action in respect of the non-compliance with conditions imposed on a planning permission and the unauthorised erection of an industrial unit on sites within Orchardbank Industrial Estate, Forfar.

After noting the history of the case, the Committee agreed that in light of a new planning application having been received enforcement action proceed as required.

4. HOT FOOD TAKEAWAYS - POLICY

There was submitted Report No 947/97 by the Director of Planning, Transport and Economic Development detailing a possible policy for the handling of hot food takeaway applications.

The Committee noted the issues surrounding this type of development and agreed:-

(I) to approve the policy contained in Report 947/97;

(ii) to include the policy in the emerging Angus Local Plan; and

(iii) to authorise publication of the policy as an addition to the Council’s standardised range of Advice Notes.

5. LINDSAY AISLE, EDZELL - OBJECTIVE 5B APPLICATION

There was submitted Report No 939/97 by Director of Planning, Transport and Economic Development detailing the lead role of Angus Council in an Objective 5B application, in partnership with Historic Scotland to repair the Lindsay Ailse, Edzell and provide interpretative material on site.

Having heard Councillor Mowatt speak in support of the application and the benefits to Edzell from participating in the project, the Committee agreed that the Council award £2,000, from this year’s Conservation budget, subject to funding from the European Union, towards the cost of restoring and interpreting the Aisle.

"That the traffic control measures to be adopted for the Hume Street/Burnside Drive and Guthrie Port/High Bridge junctions be the subject of further discussions and be agreed with the Director of Planning, Transport and Economic Development and the Council’s Director of Roads"
