MINUTE of SPECIAL MEETING of the DEVELOPMENT CONTROL COMMITTEE held in Timmergreens Primary School, Arbroath on Thursday 10 December 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND and SANDY WEST.

1.    NATIONAL PLANNING POLICY GUIDELINE 8 - TOWN CENTRES AND RETAILING

There was submitted Report No 1313/98 by the Director of Planning and Transport apprising the Committee of the updated version of National Planning Policy Guideline 8 issued by the Scottish Office in October 1998 on town centres and retailing. The Report summarised National Planning Policy Guideline 8, with particular regard to setting the national planning policy context for the consideration of proposed retail and commercial leisure developments on out of centre sites in Arbroath.

The Director of Planning and Transport outlined the broad policy objectives which were detailed in the Report, by means of a presentation at the meeting.

The Committee thereafter noted the contents of the Report.

2. ARBROATH RETAIL STUDY

There was submitted Report No 1329/98 by the Director of Planning and Transport attached to which was a copy of the Lickley Proctor & Burnett study of Arbroath carried out on behalf of the Council.

The purpose of the study had been to assess how Arbroath was performing in retailing terms and to identify key factors which should be addressed. The Report provided useful information in relation to both development plan and development control, including consideration of the current retail proposals in Arbroath.

The Committee noted the findings detailed in the Arbroath Retail Study by Lickley, Proctor and Burnett.

3. RETAIL PLANNING IN ARBROATH - CONTEXT

There was submitted Report No 1312/98 by the Director of Planning and Transport which provided a context for the consideration of the planning applications for major decentralised retail developments in Arbroath. It drew upon National Planning Guidance, Structure and Local Plan policies and proposals, the study of Arbroath Town Centre by Lickley Proctor & Burnett, shopping patterns and retail trends.

The information and the conclusion in the Report was intended to be useful in considering the proposals for retail development at Gayfield and Westway, Arbroath. The Report also detailed a list of planning policies which were particularly relevant to the consideration of the specific planning applications.

After hearing the Director of Planning and Transport, the Committee agreed:-

(i) to note the information in the Report and take into account its findings in the consideration of proposals for retail development in Arbroath; and

(ii) to refer to the Appendix which contained the list of planning policies in considering the planning applications for Gayfield, Denfield, Inchcape Park and Westway, Arbroath.

4. PLANNING APPLICATIONS

The Committee agreed to hear the following persons who had requested an opportunity to address the meeting in terms of Standing Order 13:

9. Miss Karen Fleming (on behalf of Arbroath FC)

10. Agents for Glenmorrison Group

11. Mr Dan McDonald (agent for Carswell Properties)

After members' questions had been asked and answered, the Committee proceeded to consider the following planning applications.

Councillor Shand declared an interest and withdrew from the meeting. Councillor Speirs declared an interest in Arbroath FC arising from his being the club doctor.

(a) Arbroath Football Stadium, Gayfield, Dundee Road, Arbroath

There was submitted planning application No 01/98/0460 for a proposed retail park comprising garden centre, fast food unit and associated car parking and landscaping at Arbroath Football Stadium, Gayfield, Dundee Road, Arbroath by Arbroath Football Club as detailed in Report No 1324/98 by the Director of Planning and Transport who recommended refusal.

Having heard Councillors Milne, King, William Middleton, Ian Angus and Speirs, the Committee agreed to refuse the application for the reasons set out in Report No 1324/98.

(b) Arbroath Football Stadium, Gayfield, Dundee Road, Arbroath

The Committee noted that planning application No 98/01132/OUT for outline consent for the erection of two 10,000 sq. ft retail units and associated car parking and landscaping by Arbroath Football Club/Glenmorrison Group at Arbroath Football Stadium, Gayfield, Arbroath had been withdrawn.

(c) Relocation of Arbroath Football Club to Denfield, Forfar Road, Arbroath

There was submitted planning application No 98/01133/OUT for the relocation of Arbroath Football Club, 5,000 sq. ft business unit, 10,000 sq. ft car showroom and associated car parking and landscaping at Denfield, Forfar Road, Arbroath by Arbroath Football Club/Glenmorrison Group as detailed in Report No 1324/98 by the Director of Planning and Transport who recommended refusal.

Various members were heard on the application, following which the Committee agreed to refuse the application for the reasons detailed in Report No 1324/98.

(d) Junction of Dundee Road/Westway, Arbroath

There was submitted planning application No 01/98/0462 for full planning permission for retail development (Phase 1) to include Travel Lodge, fast-food outlet, petrol station, D.I.Y. store, garden centre, four retail units and associated car parking and landscaping at the junction of Dundee Road/Westway, Arbroath by Carswell Properties, as detailed in Report No 1324/98 by the Director of Planning and Transport who recommended conditional approval.

The Committee agreed to approve the application, subject to the conditions detailed in Report No 1324/98, with Condition 2 being amended to read

"that no more than one retail unit shall be used for the sale of each of the following (a) D.I.Y. and hardware; (b) electrical goods; (c) furniture; (d) floor coverings; and (e) textiles, without the prior consent of the planning authority."

(e) Junction of Dundee Road/Westway, Arbroath

There was submitted planning application No 01/98/0655 for outline consent for the retail development (Phase 2) retail supermarket and cinema complex with associated car parking and landscaping at the junction of Dundee Road/Westway, Arbroath by Carswell Properties Ltd. as detailed in Report No 1324/98 by the Director of Planning and Transport who recommended refusal.

The Committee agreed to refuse the application for the reasons detailed in Report No 1324/98.
