MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 13 August 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 28 May and 18 June 1998 were approved as a correct record and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 5 June to 31July 1998 a total of 29 Amendments to Warrants and 257 Building Warrants had been approved with the estimated total value of the work amounting to £12,267,099.

3. PLANNING APPLICATIONS

There was submitted Report No 806/98 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iv) Withdrawn Application

To note that Application No 02/98/0029 by J Carswell Properties for the part demolition of a bonded warehouse at Dens Road, Arbroath had been withdrawn.

- (v) Debated Application

The Committee considered Application No 01/97/1886 by Auchterhouse Country Sports for the expansion of Outdoor Facilities and new restaurant at Auchterhouse Country Sports, Burnhead Farm, Auchterhouse as detailed in Report No 806/98 (List C) by the Director of Planning and Transport, who recommended conditional approval.

After slides were shown and an agent for two objectors had addressed the meeting, the Committee unanimously agreed to amend the following conditions:-

5. "………….limits set out in any condition attached to this planning consent, shooting at the application site will cease………………." AND delete "as identified by conditions 1 and 3 of this consent".

7. That for a maximum of six Sundays during the period of one year from the date of the consent, the shooting will be allowed between the hours of 10 a.m. to 5 p.m. for major events notified to the Planning Authority for its prior approval. The effects of this condition being limited to a period of 12 months from the date of this consent.

19. Replace "informed" with "formed".

COUNCILLOR RITCHIE, SECONDED BY COUNCILLOR MOWATT, MOVED THAT CONSENT BE GRANTED SUBJECT TO CONDITION 6 BEING ALSO AMENDED TO DELETE MONDAY 10.00 AM - 6.00 PM.

Councillor Ellis seconded by Councillor McGlynn moved that consent be granted but that Condition 6 be not amended.

On a vote being taken, the members voted:-

for the motion:-

Councillors Mrs Ritchie, Mowatt, Doig, King, Mrs Lamont, Middleton, Selfridge and Young (8).

for the amendment:-

Councillors Ellis, McGlynn, Milne, Shand and West (5).

The motion was declared carried resulting in the application being granted subject to the hours of operation for the target range and all terrain vehicle course in Condition 6 being:-

Tuesday 10.00 am - 8.30 pm

Wednesday to Friday 10.00 am - 6.00 pm

Saturday 10.00 am - 5.00 pm

(vi) Deferred Application

To defer consideration of Application No 01/98/0479 by Northmuir Developments Ltd for the erection of a dwellinghouse at The Kennels, Cadgers Path, Finavon, to allow the applicant to review the house design.

4. PLANNING APPEAL DECISION - 11½ PONDERLAW STREET, ARBROATH

There was submitted Report No 807/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine an appeal against the refusal of Angus Council to grant consent for change of use of a workshop/store to house at 11½ Ponderlaw Street, Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

5. WASTE GROUND AT ELGIN PLACE, ARBROATH

There was submitted Report No 808/98 by the Director of Planning and Transport detailing the circumstances relating to a recommendation to serve a Wasteland Notice on an area of overgrown waste land at Elgin Place, Arbroath.

The Committee agreed:-

(i) to serve a Wasteland Notice in respect of ground at Elgin Place; and

(ii) to recommend that the Council, as a final sanction, agree in principle to acquire the ground, by compulsory acquisition if necessary, for a public amenity strip.
