MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 15 January 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, BRIAN MILNE, STEWART McGLYNN, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors Mrs RENATE LAMONT and WILLIAM MIDDLETON.

Councillor MRS RITCHIE, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 24 November to 22 December 1997 a total of 92 Building Warrants had been approved and 13 warrants amended with the estimated total value of the work amounting to £1,772,096.

2. INSTALLATION OF ANTENNA DISHES AND MICROWAVE DISH - BALWYLLO COTTAGES, BY MONTROSE - MERCURY PERSONAL COMMUNICATIONS LIMITED

With reference to Article 3(ii) of the minute of meeting of this Committee of 13 November 1997, when a planning submission for a 25.5 metre mast adjacent to the Railway Bridge at Balwyllo Farm had been refused, it was reported and noted that an alternative site to the north-west of Balwyllo Cottages had been identified for the erection of a 15 metre high mast for which planning permission was not required.

3. R S HILL, DOUGLASTOWN

With reference to Article 3(c) of the minute of meeting of 2 October 1997, when it was noted that R S Hill had been allowed until 1 January 1998 to cease using a builders yard without consent, it was reported that he had now applied for planning permission for the storage of building materials on ground at Scoggerfield Farm Steading.

The Director of Planning, Transport and Economic Development intimated that the outcome of a further appeal was awaited and that the whole matter would take some time to resolve. In the meantime various letters had been received from members of the public expressing concern that a further extension of time was being considered.

In all the circumstances the Committee agreed to a six month extension of the time to 1 July 1998 in order that the matter might be resolved.

4. HOUSING FOR THE ELDERLY - WESTWAY, ARBROATH

With reference to Article 2(iii) when the Committee had agreed to the erection of 16 houses for the elderly at Hospitalfield, Westway, Arbroath subject to a Section 75 Agreement being signed relating to residents being over 55 years of age, it was reported that the developer had been experiencing problems with the terms of this condition and had asserted that he had been unable to raise suitable finance for the project.

COUNCILLOR MRS RITCHIE, SECONDED BY COUNCILLOR ELLIS, MOVED THAT THE CONDITION BE RELAXED TO 50 AND OVER.

Councillor Milne, seconded by Councillor Shand, moved that the age condition be removed and that an additional condition be imposed requiring that any otherwise "permitted" extensions to houses within the area covered by the existing consent, should require planning permission.

On a vote being taken, the members voted:-

For the motion:-

Councillors Mrs Ritchie, Mowatt, Doig, Ellis, McGlynn, Selfridge, West and Young (8).

For the amendment:-

Councillors Milne and Shand (2).

The motion was declared carried and became the finding of the meeting resulting in a relaxation of the age condition from 55 and over to 50 and over.

5. PLANNING APPLICATIONS

There was submitted Report No 34/98 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Refusals

To refuse consent, for the reasons recommended by the Director of Planning, Transport and Economic Development (except application 01/97/2026), in respect of the applications detailed in List B of the Report and/or appended to this minute.

(iii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Withdrawn Applications

To note that application nos D19200 and D20783 had been withdrawn.

(v) Debated Applications

Councillor Shand declared an interest in the following item and took no part in the discussion.

(a) With reference to Article 2(b) of the minute of meeting of this Committee held on 23 October 1997, the Committee considered applications nos 01/97/1102 and 02/97/2030 by M Macari for a proposed rear extension to Hot Food Shop at 10 Shore, Arbroath as detailed in Report 34/98 (List B) by the Director of Planning, Transport and Economic Development who recommended refusal.

Slides were shown and Mr Macari addressed the Committee.

COUNCILLOR MOWATT, SECONDED BY COUNCILLOR SELFRIDGE, MOVED THAT THE APPLICATION BE REFUSED AS DETAILED IN THE REPORT.

Councillor Ellis, seconded by Councillor McGlynn, moved that the application be approved, subject to the following conditions:-

(i) that the operation of the hot food take away service be restricted to between the hours of 8.00 am and 11 pm;

(ii) that the external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning, Transport and Economic Development prior to the commencement of the work;

(iii) that no live, taped or recorded music be played on the premises.

On a vote being taken, the members voted:-

Councillors Mowatt, Doig, King, Milne, Selfridge, West and Young (7).

For the amendment:-

Councillors Ellis and McGlynn (2).

The motion was declared carried and became the finding of the meeting, resulting in the application being refused.

(b) The Committee considered application no 01/97/1893 by UK Waste Management Limited for a storm area for temporary deposit/storage of waste, catch pit storage area for street sweepings and small area for recycling paper and cardboard at Knowehead Landfill Site, Wellbank as detailed in Report 34/98 (List C) by the Director of Planning, Transport and Economic Development who recommended conditional approval.

Slides were shown and an objector addressed the Committee.

COUNCILLOR MRS RITCHIE, SECONDED BY COUNCILLOR MOWATT, MOVED THAT THE APPLICATION BE CONDITIONALLY APPROVED AS DETAILED IN THE REPORT.

Councillor Ellis, seconded by Councillor McGlynn, moved that the application be refused.

On a vote being taken, the members voted:-

For the motion:-

Councillors Mrs Ritchie, Mowatt, Doig, King, Milne, Selfridge, Shand, West and Young (9).

For the amendment:-

Councillors Ellis and McGlynn (2).

The motion became the finding of the meeting resulting in the application being conditionally approved as detailed in the Report.

6. PLANNING APPEAL DECISIONS

(a) 27 School Road, Arbroath

There was submitted Report No 31/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a fence at 27 School Road, Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

(b) 29 Bractullo Gardens, Letham

There was submitted Report No 30/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of two fences at 29 Bractullo Gardens, Letham.

The Committee noted that the Secretary of State had dismissed the appeal.

(c) Lamonfauld Road, Hillside, by Montrose

There was submitted Report No 29/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a house at Lamonfauld Road, Hillside.

The Committee noted that the Secretary of State had dismissed the appeal.

(d) 12 Barns of Claverhouse Holdings, Tealing

There was submitted Report No 32/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the refusal by Angus Council to grant consent for the erection of a house at 12 Barns of Claverhouse Holdings, Tealing.

The Committee noted that the Secretary of State had dismissed the appeal.

7. REVISED PLANNING BRIEF FOR FINAVON VILLAGE

There was submitted Report No 35/98 by the Director of Planning, Transport and Economic Development suggesting proposed revisions to the Finavon Village Planning Brief approved by the Council, in order to provide up-to-date guidance for the development of the remaining plots and outstanding infrastructure at Finavon Village, by Forfar.

The Committee approved the proposed revisions to the current brief.
