MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday18 June 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, WILLIAM DOIG, ALEX KING, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors STEWART MOWATT, FRANK ELLIS and Mrs RENATE LAMONT.

Councillor Mrs RITCHIE, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 27 April to 15 May 1998 a total of 9 Amendments to Warrants and 79 Building Warrants had been approved with the estimated total value of the work amounting to £7,314,610.

2. PLANNING APPLICATIONS

There was submitted Report No 710/98 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport or, where recorded, reasons approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

3. PLANNING APPEAL DECISION - 10 THE SHORE, ARBROATH

There was submitted Report No 711/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for an extension to a hot food take-away at 10 The Shore, Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

4. ENFORCEMENT ACTION AT NO 2 ALFRED STREET, MONTROSE

There was submitted Report No 712/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in connection with the removal of three sash and case windows and their substitution with UPVC double glazed units at 2 Alfred Street, Montrose.

The owner of the property, Mr Fraser, addressed the Committee.

The Committee thereafter agreed that enforcement action be taken in relation to the removal of the three sash and case windows and their substitution with UPVC double glazed units at 2 Alfred Street, Montrose, but that implementation of the action be delayed to permit Mr Fraser time to discuss with the Director of Planning and Transport an acceptable solution.

5. DEPARTMENTAL SERVICE PLAN 1998/99

With reference to Article 5 of the minute of meeting of the Planning and Transport Policy Committee of 11 June 1998, there was submitted and noted Report No 626/98 detailing the Planning and Transport Department Service Plan for 1998/99.

6. DEVELOPMENT CONTROL CHARTER

With reference to Article 7 of the minute of meeting of this Committee of 16 April 1998, there was submitted Report No 713/98 by the Director of Planning and Transport to which was appended a copy of the Department’s Customer Care Charter for Development Control.

The Committee welcomed publication of the Charter and agreed that it be made available to the general public.

7. PERFORMANCE INDICATOR INFORMATION 1996/97

There was submitted Report No 714/98 by the Director of Planning and Transport detailing a Report recently published by the Accounts Commission for Scotland giving Performance Indicator information for 1996/97.

The Committee approved the terms of the Report and acknowledged the favourable performance of the Department as detailed in the appendix to the Report.

8. ADVICE NOTE ON LISTED BUILDINGS AND CONSERVATION AREAS

There was submitted Report No 715/98 by the Director of Planning and Transport with attached draft copy of the Planning and Transport Department’s Advice Note on Listed Buildings and Conservation Areas.

The Committee approved the contents of the draft and agreed that the Advice Note be made available to the general public and agents.

9. CAR PARKING STANDARDS FOR HOUSING ASSOCIATION DEVELOPMENTS

With reference to Article 12 of the minute of meeting of the Roads Committee of 11 June 1998, there was submitted Report No 657/98 by the Director of Roads recommending the parking standards to be implemented for developments by housing associations.

The Committee, for its interest, agreed to the continuation of the current standards, as detailed in the Report, as a basis for approving off street car parking provided for housing association developments.

The following items were, on the determination of the Convener, dealt with as matters of urgency in view of the need to approve the proposals prior to the Council's summer recess.

10. PLANNING AND TRANSPORT - BEST VALUE SERVICE REVIEW PLAN

There was submitted Report No 736/98 by the Director of Planning and Transport setting out details of the proposed Best Value Service Review Plan for the Planning and Transport Department.

The Committee agreed:-

(i) to approve, in principle, the five year Best Value Service Review Plan; and

(ii) to approve the timescale for the first tranche of reviews in 1998/99.

11. PLANNING APPLICATION NO 01/98/0295 - EXTENSION TO DWELLINGHOUSE AT BERRYFAULD, ARBROATH

With reference to Article 3(iii) of the minute of meeting of this Committee of 28 May wherein it was agreed to approve the above application, the Committee endorsed the following conditions to be imposed on the consent:-

(i) that none of the existing trees or hedges within the site shall be felled, topped, lopped or otherwise interfered with without the prior written consent of the Director of Planning and Transport;

(ii) that additional trees shall be planted within six months of the completion of the development to the satisfaction of the Director of Planning and Transport; and

(iii) that no development takes place until a scheme landscaping has been submitted to, and approved by, the Director of Planning and Transport.

12. COUNCIL RECESS - SPECIAL MEETING

The Committee noted that the Convener had decided that a special meeting of this Committee be held on Thursday 16 July 1998 at 6.00 pm to allow planning applications to be dealt with timeously.
