ANGUS COUNCIL

MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 22 October 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND, SANDY WEST and THOMAS I N YOUNG.

1. BUILDING WARRANTS

The Committee noted that in the period 21 September to 9 October 1998 a total of 10 Amendments to Warrants and 78 Building Warrants had been approved with the estimated total value of the work amounting to £1,481,971.

2. PLANNING APPLICATIONS

There was submitted Report No 1107/98 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Notices of Intention to Develop

To note two proposals by the authority to develop land as set out in the applications detailed in the Appendix.

(iv) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or, where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

3. PLANNING APPEALS

(a) 41 Castle Street, Forfar

There was submitted Report No 1108/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary State to determine the appeal against the refusal of Angus Council to grant consent for three illuminated advertisement panels at 41 Castle Street, Forfar.

The Committee noted that the Secretary of State had dismissed the appeal.

(b) Site Y, Letham Grange, Colliston

There was submitted Report No 1109/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of two houses at Letham Grange.

The Committee noted that the Secretary of State had dismissed the appeal

(c) Plots 5 and 7, Peebles, Letham Grange, Arbroath

There was submitted Report No 1110/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the sub-division of plots 5 and 7 in the Peebles area of Letham Grange to form an additional house plot.

The Committee noted that the Secretary of State had dismissed the appeal.

(d) Plots 12 and 13, Peebles, Letham Grange, Arbroath

There was submitted Report No 1111/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the sub-division of plots 12 and 13 in the Peebles area of Letham Grange to form an additional house plot.

The Committee noted that the Secretary of State had upheld the appeal.

(e) 13 Renny Crescent, Montrose

There was submitted Report No 1112/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of a dwelling house at 13 Renny Crescent, Montrose.

The Committee noted that the Secretary of State had upheld the appeal.

4. CONSERVATION GRANT APPLICATION AT KIRKHOWE OF RUTHVEN

With reference to Article No 4 of the Development Control Committee of 2 October 1997, when it had been agreed to award a grant of £1,000 towards the re-roofing works to the Kirkhowe of Ruthven, there was submitted Report No 1114/98 by the Director of Planning and Transport recommending that the original grant be increased to £3,000.

The Report noted that the additional proposals had not fully met the spirit of the Council’s Conservation Grant Policy as the roof was to be raised by 20cms. The Council had not considered this to be necessary, but as a gesture of goodwill had agreed to award a grant of £1,000.

However, since that time the work had been completed and on inspection it had been found that the wallhead had not materially been raised. Had the original application been submitted showing only a slight increase, a Conservation Grant of £3,000 would have been awarded.

Accordingly, the Committee agreed that the original £1,000 Conservation Grant, be increased to £3,000 in accordance with the Council approved policy.

5. EXCLUSION OF PUBLIC AND PRESS

The Committee resolved that the public and press be excluded during consideration of the following matter so as to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, paragraph 6.

6. ST JAMES CHURCH, FORFAR

There was submitted Report No 1113/98 by the Director of Planning and Transport on St James Church, Forfar which was a prominently situated listed building and was open to the elements.

The Report advised that attempts had been made to identify an owner of the building and it had been established that there was no owner on whom an Urgent Works Notice under Section 49 of the Planning (Listed Building and Conservation Areas) (Scotland) Act 1997 could be served.

The Committee approved the terms of the Report and the proposals contained therein and that a further Report be submitted prior to 31 December 1998.
