MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday, 26 February 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors ALEX SHAND and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 26 January 1998 to 13 February 1998 a total of 65 Building Warrants had been approved and 9 warrants amended with the estimated total value of the work amounting to £3,380,957.

2. FLEDMYRE QUARRY EXTENSION - SECTION 75 AGREEMENT

With reference to Article 3 of the minute of meeting of this Committee of 5 February 1998, when it was agreed that the Section 75 Agreement be amended to allow the creation of a small scale car park and viewing area at Fledmyre Quarry, there was submitted a note advising that it would be possible to impose a condition which would negate the requirement to include the car parking area in the Section 75 Agreement. This would reflect Government advice that planning conditions should be used where appropriate rather than Section 75 Agreements.

The Committee agreed that an additional condition be imposed to allow for the formation of the car park and viewing area in the terms recommended by the Director of Planning, Transport and Economic Development and detailed on the agenda for the meeting.

3. PLANNING APPEALS

(a) Cunmont Quarry, Newbigging

It was reported that the appeal against the Council’s refusal of planning consent for Cunmont Quarry, Newbigging lodged with the Secretary of State was to be determined via a public inquiry, at the request of the applicant.

The Committee agreed that consultants and, if necessary, Counsel be engaged to assist with the preparation for the inquiry.

The following matter was, on the determination of the Convener, dealt with as a matter of urgency in view of the impending public inquiry.

(b) Guthrie Quarry, Guthrie

The Convener reported that a public inquiry was to be held in June to determine an appeal against the refusal of planning consent in respect of the application for Guthrie Quarry.

The Committee agreed that planning consultants and, if required, Counsel be engaged to assist with preparation for the inquiry.

4. PLANNING APPLICATIONS

There was submitted Report No 229/98 by the Director of Planning, Transport and Economic Development on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning, Transport and Economic Development as detailed in List A of the Report.

(ii) Recommended Approvals

To grant consent, subject to the conditions recommended by the Director of Planning, Transport and Economic Development and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute [except application nos 01/97/2124 and 01/98/002].

(iii) Refusals

To refuse consent in respect of :

(a) application no 01/97/2124 for the erection of 12 houses at Westfield and Lindsay Street, Kirriemuir as the proposed development did not conform with the Kirriemuir Local Plan nor the Tayside Structure Plan, the Committee having first seen slides and heard the applicant; and

(b) application no 01/98/0002 for a roofspace extension to 46 Grange Road, Monifieth as the proposed development was not in keeping with the surrounding properties and would set a precedent for the area, the Committee having first seen slides and heard two objectors.

It was noted that the grounds of refusal of these applications would be reported in their full form to this Committee, for information, on 19 March.

Councillor Ritchie asked that her dissent from the decision in (iii)(b) above be recorded

5. PLANNING APPEAL DECISION - THE STEADINGS, RESWALLIE MAINS, FORFAR

There was submitted Report No 232/98 by the Director of Planning, Transport and Economic Development on the outcome of an appeal against the conditions imposed by Angus Council on a planning consent granted for the storage of vehicles at the Steadings, Reswallie Mains, Forfar.

The Committee noted that the Secretary of State had dismissed part of the appeal and in part replaced the conditions with new conditions.

6. ENFORCEMENT ACTION

(a) 125/127 Bridge Street, Montrose

There was submitted Report No 231/98 by the Director of Planning, Transport and Economic Development detailing the circumstances surrounding the recommendation to take enforcement action in relation to the installation of two double glazed UPVC window units on the front elevation of the second floor flat at 125/127 Bridge Street, Montrose.

The Committee agreed that enforcement action be taken.

(b) 42 Bridge Street, Montrose

There was submitted Report No 228/98 by the Director of Planning, Transport and Economic Development detailing the circumstances relative to a recommendation to take enforcement action in relation to the installation of three double glazed UPVC window units on the front elevation of the first floor flat at 42 Bridge Street, Montrose.

The Committee agreed that enforcement action be taken.

7. HISTORIC BURGHS ASSOCIATION OF SCOTLAND - ANNUAL CONFERENCE, MONTROSE, 27-28 MARCH 1998

There was submitted Report No 233/98 by the Director of Planning, Transport and Economic Development advising members that the Historic Burghs Association of Scotland were to be holding their annual conference in Montrose on 27/28 March 1998.

The Committee agreed to support the Historic Burghs Association of Scotland’s Annual Conference and to contribute £1,500 towards the cost of the conference from the Conservation budget.
