MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 28 May 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, SANDY WEST and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors STEWART McGLYNN and ALEX SHAND.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 16 April and 7 May 1998 were approved as a correct record and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 27 April to 15 May 1998 a total of 79 building warrants had been approved and 9 warrants amended, with the estimated total value of the work amounting to £7,314,610.

Councillor King declared an interest in Building Warrant 98/00428.

3. PLANNING APPLICATIONS

There was submitted Report No 557/98 by the Director of Planning and Transport on applications for planning consent.

After noting that Application No 03/98/0017 (5 High Street, Carnoustie) had been withdrawn, the Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport or, where recorded, reasons approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport and/or where recorded, any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iv) Deferred Applications

To note that Application No 01/97/2071 for the erection of four houses on former garage site at Kirkton of Kingoldrum, by Kirriemuir had been deferred to allow further consultation with the Roads Department.

4. ERECTION OF DWELLINGHOUSE AT OATHLAW BY FORFAR

There was submitted Report No 558/98 by the Director of Planning and Transport detailing the decision taken by the Planning Department in assessing an amendment to an application for the development of a dwellinghouse at Oathlaw previously granted approval by the Council under the delegated powers procedure.

The Report advised that Mr B Stott had been granted, under delegated powers, approval for the erection of a dwellinghouse at Oathlaw, by Forfar and that it had been brought to the Council’s attention, by a third party, that the house was not being built in accordance with the approved plans.

An agent for an objector was heard who urged the Council to seek a full application from Mr Stott which would allow existing residents to express their concerns in the usual way.

The Committee expressed concern at Mr Stott’s actions, but as the amendments were not significant, agreed to accept the changes made during the development of the dwellinghouse at Oathlaw, by Forfar as an amendment to the approved plans and to take no further action.

5. BREACH OF PLANNING CONSENT, PLOT 4, THE BEECHES, CORTACHY ROAD, KIRRIEMUIR

There was submitted Report No 559/98 by the Director of Planning and Transport which detailed the non compliance with the terms of planning consent 01/97/2115 (change of house type at Plot 4, Cortachy Road, Kirriemuir).

The Report noted that although the external wall finish fronting onto Cortachy Road was primarily red reconstituted stone rather than brown roughcast, it was acceptable, and enforcement action was therefore not warranted.

The Committee agreed to take no further action.

6. PLANNING APPEAL DECISION - BALBEUCHLEY STEADING, AUCHTERHOUSE

There was submitted Report No 560/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for three houses at Balbeuchley Steading, Auchterhouse.

The Committee noted that the Secretary of State had upheld the appeal.

7. ENFORCEMENT ACTION - THE GEORGE HOTEL, 22 GEORGE STREET, MONTROSE

There was submitted Report No 561/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in relation to signwork illuminated by six downlighters and two illuminated forward projecting box signs on the business premises known as The George Hotel, 22 George Street, Montrose.

The Committee agreed that enforcement action be taken.

8. TREE PRESERVATION ORDER 1997 NO 2 - WESTFIELD LOAN, FORFAR

There was submitted Report No 562/98 by the Director of Planning and Transport recommending that provisional Tree Preservation Order 1997 No 2, which came into effect on 18 December 1997 under the terms of Section 59 of the Town and Country Planning (Scotland) Act 1972, be now confirmed. The Order had been made by the Director of Planning and Transport under delegated powers because trees at Westfield Loan, Forfar were considered to be at risk from a planning application.

The Committee agreed to confirm Tree Preservation Order 1997 No 2.
