MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 3 December 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, Mrs RENATE LAMONT, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, SANDY WEST and THOMAS I N YOUNG.

1. BUILDING WARRANTS

The Committee noted that, in the period 2 to 20 November 1998, a total of 15 Amendments to Warrants and 70 Building Warrants had been approved with the estimated total value of the work amounting to £2,342,106.00.

2. PLANNING APPLICATIONS

There was submitted Report No 1280/98 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or, where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iv) Deferrals

(a) To defer consideration of Application No 98/01212/FUL by Keith Watson for the erection of four houses at Wellington Park, Montrose, slides having first been shown of the application site and the local member, Councillor Crowe, heard; and

(b) To defer consideration of Application No 01/98/0679 by Muirfield Contracts Limited for the demolition of Howden Villa and the construction of 16 houses at Howden Village, Hillside, Montrose.

3. REVENUE BUDGET 1999/2000

There was submitted Report No 1224/98 by the Director of Finance advising the Committee of the latest position with regard to the preparation of the Departmental 1999/2000 Revenue Budget and associated issues.

An Appendix to the Report summarised the provisional base budget for the Department of Planning and Transport for 1999/2000 as submitted to the Director of Finance and subsequently reviewed by the Technical Validation Group.

The Committee agreed to note the contents of the Report for its interest and that a more detailed report with specific recommendations would be submitted later in the budget cycle.

4. ENFORCEMENT ACTION

(a) ‘Chandra’, Dronley Road, By Muirhead

There was submitted Report No 1281/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in respect of a breach of a planning condition imposed on consent granted by the former City of Dundee District Council on 27 May 1991 for the erection of a domestic garage.

The Committee agreed that enforcement action be taken.

(b) 7 Blairfield Road, Birkhill

There was submitted Report No 1282/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in respect of material change of use at land at 7 Blairfield Road, Birkhill, from garden ground to land used to park/store commercial vehicles.

The Committee agreed that enforcement action be taken.

(c) Bridgefoot Farm, Bridgefoot

There was submitted Report No 1283/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in respect of a failure to comply with Condition 14 and the approved plans, submitted in respect of Application 01/96/1172, relative to the upfilling of land within the curtilage of Bridgefoot Farm House, Bridgefoot.

The Committee agreed that enforcement action be taken.

(d) 16 Wood Road, Birkhill

There was submitted Report No 1284/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in respect of the change of use of the domestic garage at 16 Wood Road, Birkhill, to a garage workshop.

The Committee agreed that enforcement action be taken.

(e) Small Holding, Memus Village

With reference to Article 4(c) of the minute of meeting of this Committee held on 16 April 1998, when it was agreed that the owner of the small holding would be given three months to remove the second caravan which had been placed on the site at Memus Village, it was reported that the three months had now expired and the caravan remained on site.

The Committee therefore agreed that enforcement action be taken to remove the second caravan.

5. PLANNING APPEAL DECISIONS

(a) 240c High Street, Arbroath

There was submitted Report No 1285/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine an appeal against the refusal of Angus Council to grant consent for the change of use of flat to office at 240c High Street, Arbroath.

The Committee noted that the Secretary of State had upheld the appeal.

(b) Eddie Avenue, Brechin

There was submitted Report No 1286/98 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of two houses at Eddie Avenue, Brechin.

The Committee noted that the Secretary of State had dismissed the appeal.

6. CONSERVATION GRANTS FOR SHOPFRONTS AND ADVERTISEMENTS

There was submitted Report No 1287/98 by the Director of Planning and Transport detailing how the Conservation Grants budget could be used to assist small traders in carrying out enhancement work to shop fronts within conservation areas.

The Report noted that experience of the operation of the Conservation Grants budget suggested that a number of small, but highly desirable conservation/related projects could be funded each year and whilst the projects would be small, the visual and public impact could be significant to a town.

The Committee therefore agreed to award Conservation Grants, for certain desirable improvements to shop fronts in conservation areas, on the basis of the criteria detailed in the Report.

7. PLANNING ENFORCEMENT CHARTER

There was submitted Report No 1167/98 by the Director of Planning and Transport enclosing a copy, for information, of the Planning and Transport Department’s Customer Care Charter for Planning Enforcement.

The Committee agreed that the Charter be adopted and made available to the general public.

8. EXCLUSION OF PUBLIC AND PRESS

The Committee resolved in terms of Standing Order 27(2), to exclude the public and press during consideration of the following item in order to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973 (paragraph 13).

9. BUILDING PRESERVATION NOTICE - KINNORDY ROAD, KIRRIEMUIR

There was submitted Report No 1289/98 by the Director of Planning and Transport detailing the reasons for a recommendation to place a Building Preservation Notice on property at Glenhill, Kinnordy Road, Kirriemuir, which was an Arts and Crafts/Art Nouveau Villa of 1902 date.

The Report noted that the building was presently at risk and worthy of statutory listing but was not included in the List of Buildings of Special Architectural or Historic Interest for Kirriemuir Burgh.

The Committee therefore agreed that a Building Preservation Notice be served on the owner of Glenhill, Kinnordy Road, Kirriemuir, and that Historic Scotland be requested to include the building in the statutory List of Buildings of Special Architectural or Historic Interest for Kirriemuir Burgh.
