MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 3 September 1998 at 6.00 pm.

Present: Councillors Mrs KATHLEEN RITCHIE, STEWART MOWATT, WILLIAM DOIG, FRANK ELLIS, ALEX KING, STEWART McGLYNN, WILLIAM MIDDLETON, BRIAN MILNE, DAVID SELFRIDGE, ALEX SHAND and THOMAS I N YOUNG.

Apologies: Apologies for absence were intimated on behalf of Councillors Mrs RENATE LAMONT and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 3 August to 14 August 1998 a total of 3 Amendments to Warrants and 81 Building Warrants had been approved with the estimated total value of the work amounting to £2,657,050.

2. PLANNING APPLICATIONS

There was submitted Report No 936/98 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in List B of the Report and appended to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in List C of the Report and appended to this minute.

(iv) Deferred Application

To note that Application No 01/98/0650 for the replacement of windows at 13A-E Wharf Street, Montrose had been deferred to the next meeting of the Committee.

3. PRIOR NOTIFICATION - PLANNING APPLICATION NO AG/98/0010

There was submitted a note advising that Councillor Ian Mackintosh had submitted a planning application for the erection of a general purpose agricultural building at Kirkton of Kingoldrum. Although only the "prior notification" procedure was required in this case, Councillor Mackintosh had also posted neighbour notification. This was not required with the prior approval process but it had resulted in two letters of objection being received.

The Director had taken into account the points raised by the objectors but believed the development to be acceptable.

In the circumstances, the Committee agreed that the Director of Planning and Transport issue the prior notification clearance.

4. ENFORCEMENT ACTION

(a) 7 Westport, Arbroath

There was submitted Report No 932/98 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in connection with the unauthorised erection of illuminated box signs at 7 West Port, Arbroath.

The Committee agreed that enforcement action be taken.

(b) 44 Gagiebank, Wellbank

With reference to Article 3(2) of the minute of meeting of this Committee held on 6 May 1997, when retrospective planning permission had been granted for the erection of a firewall and conservatory at 44 Gagiebank, Wellbank, there was submitted Report No 933/98 by the Director of Planning and Transport detailing an alleged breach of condition (height of wall) relating to the planning permission granted.

The Committee agreed that, as the breach had been caused by an excess in height of 5-10 cm (depending on which side the wall was measured) above the two metres specified in the planning condition, and was therefore de minimis, no further action be taken.

5. SECTION 75 AGREEMENT - PIPERDAM, BIRKHILL

With reference to Article 2(q) of the minute of meeting of Angus Council held on 2 April 1998, there was submitted Report No 934/98 by the Director of Planning and Transport on a request from the developer for a variation to the terms of the Section 75 Agreement.

The Committee agreed to revise the Section 75 Agreement and allow for the last ten house plots to be sold only after the completion of at least 20 chalets and the Osprey Centre and associated walkways and picnic areas.
