MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 2 December 1999 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE HON R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, KITTY RITCHIE, BILL ROBERTON, DAVID SELFRIDGE, and SANDY WEST.

Also present: Councillors BILL CROWE, ALISTAIR GRAY and HELEN OSWALD.

1. BUILDING WARRANTS

The Committee noted that in the period 1 - 19 November 1999 a total of 9 Amendments to Warrants and 64 Building Warrants had been approved with an estimated cost of £3,260,693.

2. PLANNING APPLICATIONS

There was submitted Report No 1252/99 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

- (iv) Debated Application

The Committee considered Application No 99/01009/FUL by Highland Adventure for the construction of an all-weather play area with fence at Knockshannoch, Glenisla as detailed in Report No 1252/99 (List B) by the Director of Planning and Transport, who had recommended refusal.

Slides were shown, following which the applicant was heard.

Councillor Ritchie seconded by Councillor McGlynn, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR HENDERSON, SECONDED BY COUNCILLOR MILNE, MOVED AS AN AMENDMENT THAT THE APPLICATION BE CONDITIONALLY APPROVED.

On a vote being taken, the members voted:-

The amendment was declared carried, resulting in the application being conditionally approved (the conditions to be submitted to the meeting of Angus Council on 16 December 1999).

(v) Deferred Application

The Committee agreed to defer consideration of application 99/01041/FUL by D Powell for the erection of a double garage at Courtyard, Woodville, by Arbroath.

3. 2000/2001 REVENUE BUDGET

With reference to Article 2 of the minute of meeting of the Planning and Transport Policy Committee of 23 November 1999, there was submitted Report No 1188/99 by the Director of Finance advising the Committee of the latest position with regard to the preparation of the Planning and Transport 2000/2001Revenue Budget and associated issues, and summarising in an Appendix to the Report the departmental provisional base budget for 2000/2001 as submitted to the Director of Finance and subsequently reviewed by the Technical Validation Group.

The Committee agreed to note the contents of the Report for its interest and that more detailed reports with specific recommendations would be submitted later in the budget cycle.

4. 1999/2003 FINANCIAL PLAN AND 2000/2001 CAPITAL BUDGET

With reference to Article 3 of the minute of meeting of the Planning and Transport Policy Committee of 23 November 1999, there was submitted Report No 1189/99 by the Director of Finance which detailed the latest position with regard to the preparation of the 1999/2003 Financial Plan (incorporating the 2000/2001 Capital Budget) for the Planning and Transport Department and summarising in an Appendix to the Report the Departmental Financial Plans for 1999/2003 as returned to the Director of Finance and subsequently reviewed by the Technical Validation Group.

The Committee agreed to note the contents of the Report for its interest and that more detailed reports with specific recommendations would be submitted later in the budget cycle.

5. PLANNING APPEAL DECISIONS

(a) Redroofs, Balgavies, Forfar

With reference to Article 3(ii) of the minute of meeting of this Committee of 8 April 1999, there was submitted Report No 1253/99 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of a dwellinghouse at Redroofs, Balgavies.

The Committee noted that the Secretary of State had dismissed the appeal.

(b) Small Holding, Memus Village

With reference to Article 4(e) of the minute of meeting of this Committee of 3 December 1998, there was submitted Report No 1254/99 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Secretary of State to determine the appeal against an Enforcement Notice served by Angus Council against the unauthorised siting of a caravan on land at Memus Village.

The Committee noted that the Secretary of State had upheld the appeal and directed that the enforcement action dated 4 May 1999 be quashed.

The Committee thereafter agreed:-

(i) to note the outcome of the appeal; and

(ii) to defer pursuing any further formal action for a period of 4 months in order to pursue a means of securing visual improvements to the site through the appellant’s agent.

6. ENFORCEMENT ACTION

LAND SOUTH OF MATTOCKS ROAD, WELLBANK

There was submitted Report No 1255/99 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in respect of a breach of a planning condition imposed on a consent granted to Buddon Ltd. relative to a residential development at Shank of Omachie, south of Mattocks Road, Wellbank.

The Committee agreed to authorise enforcement action being taken against the developer but that service of the relevant notice be delayed to allow him to fulfil the undertaking given in his letter of 30 November 1999.

7. REVISIONS TO ADVICE NOTE 14: SINGLE PLOT RESIDENTIAL DEVELOPMENT

There was submitted Report No 1256/99 by the Director of Planning and Transport which detailed a revision to Advice Note 14 on Single Plot Residential Developments.

The Report indicated that the revised policy concentrated on window to window distances for inclusion within the Advice Note, with the current references to building distances being deleted.

The Committee agreed to approve the amendments to Advice Note 14 as they pertained to window to window distances as indicated in Section 3.2 of the Report.
