MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 12 August 1999 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE HON R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, KATHLEEN RITCHIE, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPIERS and SANDY WEST.

Apology: An apology for absence was intimated on behalf of Councillor PETER MURPHY.

1. BUILDING WARRANTS

The Committee noted that during the period 5 July to 30 July 1999 a total of 115 Building Warrants and 2 amendments to Warrants had been approved with an estimated cost of £1,648,029.

2. PLANNING APPLICATIONS

There was submitted Report No 719/99 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, in respect of applications detailed in the Appendix to this minute.

(iv) Debated Application

The Committee considered Application No 99/00635/FUL by Ian Craig for the erection of two dwellinghouses at Brucefield House, Cliffburn Road, Arbroath as detailed in Report No 719/99 (List B) by the Director of Planning and Transport, who had recommended refusal.

Slides were shown, following which the applicant was heard.

Councillor McGlynn seconded by Councillor Ritchie, moved that the application be refused for the reasons detailed in the report.

COUNCILLOR MILNE, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE CONDITIONALLY APPROVED.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ellis and Ritchie (3).

For the amendment:-

Councillors Henderson, King, Leslie Melville, Lumgair, Milne, Roberton, Selfridge and West (8).

The amendment was declared carried, resulting in the application being conditionally approved, and the Committee agreed that the conditions should be submitted to its next meeting.

3. PLANNING APPLICATION - 18 LOCHSIDE ROAD, FORFAR - PLANNING CONDITIONS

With reference to Article 3(iv) of the minute of meeting of this Committee held on 13 July 1999 when it had been agreed to grant approval of Application 99/00584/COU for a change of use of premises at 18 Lochside Road, Forfar, the Committee approved the undernoted conditions recommended by the Director of Planning and Transport:-

(i) that prior to the commencement of the use hereby approved, details of all matters relating to access, off-street parking and loading/unloading facilities shall be submitted to, and approved by the planning authority;

(ii) that all loading/unloading operations shall take place within the curtilage of the site (R70);

(iii) that the premises be used for the sale of carpets and other floor coverings and textiles and soft furnishings and for no other purpose (including any other purpose in Class 1 of the Schedule to the Town and Country Planning (Use Classes) (Scotland) Order 1989) (X01);

(iv) that the hours of opening be restricted to between 8am to 8pm on Monday to Saturday and 10am to 6pm on Sunday (XO4B); and

(v) that no materials, plant, machinery, equipment, receptacles or pallets are stored between the building(s) and the public road. (Y07)

4. ENFORCEMENT ACTION

(a) RS Hill, Douglastown

With reference to Article No 5 of the minute of meeting of this Committee held on 27 May 1999, there was submitted Report No 720/99 by the Director of Planning and Transport detailing the ongoing circumstances relative to the transfer of building materials from an unauthorised builders yard/setting down area within the village of Douglastown to the authorised yard at Scroggerfield Farm, Douglastown.

The Committee noted that the approved schedule of work for the transfer of material was progressing in a satisfactory manner.

(b) Land south of Mattocks Road, Wellbank

There was submitted Report No 745/99 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in respect of a breach of a planning condition imposed on a consent granted to Buddon Limited on 7 May 1999 for the erection of a residential development at Shank of Omachie, South of Mattocks Road, Wellbank, namely the failure to provide a footpath link to the playing field required by Condition 17 of the planning consent.

The Committee agreed that enforcement action be taken.

5. PLANNING APPEAL DECISION -WOODVILLE PARK, BY ARBROATH

There was submitted Report No 747/99 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for four dwellinghouses at Woodville Park, by Arbroath.

The Committee noted that the Secretary of State had dismissed the appeal.

6. GOOD ENFORCEMENT CONCORDAT

There was submitted Report No 746/99 by the Director of Planning and Transport which advised on the introduction of a national Good Enforcement Concordat and recommended its adoption in respect of the relevant activities of the Planning and Transport Service.

After noting that the impact on the enforcement activities of the Planning and Transport Department would be minimal since the adoption of the Customer Service Charters for Building Control and Planning Enforcement embraced most of the features and recommendations of the Concordat, the Committee noted its contents and endorsed its implementation within Angus in respect of the regulatory activities of the Planning and Transport Department.
