MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Tuesday 13 July 1999 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE HON R J LESLIE MELVILLE, DAVID LUMGAIR and BILL ROBERTON.

Apologies: Apologies for absence were intimated on behalf of Councillors BRIAN MILNE, PETER MURPHY, KATHLEEN RITCHIE, DAVID SELFRIDGE and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 27 May and 17 June 1999 were submitted, approved as a correct record and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 7 June - 2 July 1999 a total of 137 Building Warrants had been approved with an estimated cost of £5,368,787.

3. PLANNING APPLICATIONS

There was submitted Report No 694/99 by the Director of Planning and Transport on applications for planning consent.

The Committee agreed as follows:-

(i) Delegated Approvals

To note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

To refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

To grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iv) Debated Application

The Committee considered Application No. 99/00584/COU by W Whitton for the change of use from store to carpet retail at 18 Lochside Road, Forfar as detailed in Report No 694/99 (List B) by the Director of Planning and Transport, who recommended refusal.

Slides were shown, following which the applicant’s agent was heard.

Councillor McGlynn, seconded by Councillor Ellis, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR KING, SECONDED BY COUNCILLOR HENDERSON, MOVED THAT THE APPLICATION BE CONDITIONALLY APPROVED.

On a vote being taken, the members voted:-

For the amendment:-

Councillors Henderson, King, Leslie Melville, Lumgair and Roberton (5).

The amendment was declared carried, resulting in the application being conditionally approved, and the Committee agreed that the conditions should be submitted to its next meeting.

4. TREE PRESERVATION ORDER NO 2 1976

UNAUTHORISED TREE WORKS - THE GRANGE, CROW HILL, MONIFIETH

There was submitted Report No. 691/99 by the Director of Planning and Transport giving details of unauthorised tree works carried out at Crow Hill, Monifieth which was protected by a Tree Preservation Order.

The Committee agreed that the Director of Planning and Transport be authorised to refer the felling of 3 No Elms at Crow Hill, Monifieth to the Procurator Fiscal when investigations were complete and subject to the evidence being deemed adequate.

5. ENFORCEMENT ACTION

(a) The Elms, Cairnie Road, Arbroath

There was submitted Report No. 692/99 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to initiate an enforcement action in respect of a material change of use of land forming part of the subjects of a listed building from garden ground to park/store for mechanical plant and diesel fuel at The Elms, Cairnie Road, Arbroath.

The Committee agreed that enforcement action be taken.

(b) Bridgefoot Farm, Bridgefoot

There was submitted Report No. 693/99 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in respect of the unauthorised alterations to ground levels on land associated with the subjects of Bridgefoot Farmhouse, Bridgefoot.

The Committee agreed that, unless a planning application which included a flood study was submitted within two months, enforcement action be taken against the owner of Bridgefoot Farmhouse in respect of the unauthorised raising of ground levels by about two metres within the curtilage of the property.

ADDITIONAL CONDITIONS
"7. That the existing junction to the A933 Brechin-Arbroath Road shall be upgraded to provide a kerbed bellmouth and shall be surfaced for the first 15 metres all in accordance with the standards of Angus Council.
8. That visibility sightlines of 9 x 215 metres shall be provided in each direction at the existing junction on A933 Brechin-Arbroath Road in accordance with the standards of Angus Council.
9. That to the satisfaction of the Director of Planning and Transport suitable drainage arrangements shall be provided to ensure surface water does not discharge from the site onto the public road and vice-versa.
10. That to the satisfaction of the Director of Planning and Transport stacking and turning space shall be provided within the site to enable vehicles to enter and leave in a forward gear.
11. That to the satisfaction of the Director of Planning and Transport the site operator shall provide wheel cleaning facilities within the site to ensure that the public road is kept clear of mud, debris etc."
