Development Control Committee

MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 3 February 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE HON R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, KITTY RITCHIE, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPIERS and SANDY WEST.

Councillor McGLYNN, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 24 December 1999 - 21 January 2000 a total of 11 Amendments to Warrants and 61 Building Warrants had been approved with an estimated cost of £2,091,234.

2. PLANNING APPLICATIONS

There was submitted Report No 156/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

(iv) Debated Application

The Committee considered Application No 99/01064/COU by Gary McIntyre for the change of use from agricultural land and outbuildings to sale and repair of motor vehicles at Lochside Farm, Forfar.

Slides were shown, following which the applicant's business partner was heard.

COUNCILLOR McGLYNN, SECONDED BY COUNCILLOR ROBERTON, MOVED THAT THE APPLICATION BE REFUSED FOR THE REASONS DETAILED IN THE REPORT.

Councillor Henderson seconded by Councillor Leslie Melville, moved that the application be granted.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ellis, King, Lumgair, Milne, Murphy, Ritchie, Roberton, Selfridge, Spiers and West (11).

For the amendment:-

Councillors Henderson and Leslie Melville (2).

The motion was declared carried, resulting in the application being refused for the reasons detailed in the Report.

(v) Withdrawn Application

The Committee agreed to note that Application No 99/00781/LBC by John Ritchie for the demolition of a building and the provision of private parking for the Old Bakehouse and Studio at the Exchange Bar, 6 ­ 10 Church Street, Brechin had been withdrawn by the applicant.

3. BEST VALUE SERVICE REVIEW: BUILDING CONTROL

There was submitted Report No 157/00 by the Director of Planning and Transport which advised the Committee of the outcome of the Building Control Best Value Service Review and sought Committee approval for the Service Improvement Plan prepared by the Review Team. A full copy of the Review had been placed in the Member's Lounge.

The Report indicated that, in terms of performance, the service compared very favourably with the other benchmarking partners and national standards. Four national statutory indicators (Scottish Executive and Accounts Commission) indicated that Angus was one of the best performing authorities in Scotland. However, the Review had identified a number of areas where further improvements would continue to be made in respect of service delivery and these were indicated in the Service Improvement Plan appended to Report 157/00.

The Committee agreed:-

  1. (i) to note and welcome the terms of the Report; and
  2. to approve the proposed Service Improvement Plan, as detailed in Appendix 1 of the Report.
