MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 24 February 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, THE Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, KITTY RITCHIE, BILL ROBERTON, DAVID SELFRIDGE and SANDY WEST.

Councillor McGLYNN, Convener, in the Chair.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee held on 13 January and 3 February 2000 were submitted, approved as a correct record and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 24 January ­ 11 February 2000 a total of five Amendments to Warrants and 63 Building Warrants had been approved with an estimated cost of £2,379,525.

3. PLANNING APPLICATIONS

There was submitted Report No 204/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iv) Debated Application

The Committee considered Application No 99/01070/LBC by John Carsewell for the demolition of an existing clay brick chimney stack at No 1 Warehouse, Old Bond, Dens Road, Arbroath.

Slides were shown.

COUNCILLOR McGLYNN, SECONDED BY COUNCILLOR ELLIS, MOVED THAT THE APPLICATION BE REFUSED FOR THE REASONS DETAILED IN THE REPORT.

Councillor King, seconded by Councillor Milne, moved that the application be granted.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ellis, Leslie Melville, Lumgair, Murphy, Ritchie, Roberton and Selfridge (8).

For the amendment:-

Councillors Henderson, King, Milne and West (4).

The motion was declared carried, resulting in the application being refused for the reasons detailed in the Report.

(v) Withdrawn Application

The Committee agreed to note that Application No 99/01253/FUL by Gordon Low for the erection of a house at Croftsmuir Farm, Redford, Carmyllie had been withdrawn.

(vi) Deferred Application

The Committee agreed to defer, at the request of the applicant, Application No 99/00694/OUT by R & N Cessford for the outline erection of a warehouse for storage and distribution purposes at former Railway Siding, Inverkeilor.

4. PLANNING APPEAL DECISION ­ 3 SCHOOL ROAD, ARBROATH

There was submitted Report No 205/00 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Scottish Executive to determine the appeal against the refusal of Angus Council to grant consent for a house extension at 3 School Road, Arbroath.

The Committee noted that the Scottish Executive had dismissed the appeal.

5. ENFORCEMENT ACTION ­ BALRUDDERY MEADOWS, FOWLIS, BY DUNDEE

There was submitted Report No 206/00 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in respect of the unauthorised erection of an isolation box and a general purpose shed on land associated with commercial equestrian stables at Balruddery Meadows, Fowlis, by Dundee.

The Committee agreed:-

  1. that the terms of a letter received from the owner of the ground after the Report had been written was not relevant to the proposed action; and
  2. that enforcement action be taken.

6. SECTION 75 AGREEMENT: PIPERDAM, MUIRHEAD

With reference to Article 5 of the minute of meeting of this Committee of 3 September 1998, there was submitted Report No 207/00 by the Director of Planning and Transport which detailed a request in respect of the Section 75 Agreement at Piperdam, Muirhead.

The Committee agreed that the Section 75 Agreement, pertaining to the housing and holiday chalets development at Piperdam, be amended as requested subject to the applicant meeting all legal costs and submitting a bond for £100,000.
