MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 16 March 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON and DAVID SELFRIDGE.

Apologies: Apologies for absence were intimated on behalf of Councillors KITTY RITCHIE and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 14 February ­ 3 March 2000 a total of eight Amendments to Warrants and 69 Building Warrants had been approved with an estimated cost of £2,509,319.

2. PLANNING APPLICATIONS

There was submitted Report No 334/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the Appendix to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the Appendix to this minute.

3. DISCHARGE OF TERMS OF SECTION 50 AGREEMENT AT "VISTANNA", DUNDEE ROAD, FORFAR

With reference to Article 267(2)/87 of the minute of meeting of the Planning and Development Committee of Angus District Council of 6 April 1987, the Committee considered the terms of a request received from Mr Gordon Webster, for the discharge of a Section 50 (now 75) Agreement pertaining to the erection of a dwellinghouse at Dundee Road, Forfar. It was noted that the Agreement stipulated that no dwellings, other than a dwellinghouse to which the planning consent related, should be erected on the subjects. However, the Forfar "development boundary" had since been re-aligned resulting in the site now lying within the built-up area of Forfar. Accordingly, the terms of the Agreement were no longer appropriate. The Committee agreed that, in the circumstances, the Section 50 Agreement be revoked.

4. PLANNING APPEAL DECISION ­ PARK ROAD, BRECHIN

With reference to Article 2(ii) of the minute of meeting of this Committee of 18 March 1999, there was submitted Report No 335/00 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Secretary of State to determine the appeal against the refusal of Angus Council to grant consent for the erection of a house on land at Park Road, Brechin. The Committee agreed to note that the Secretary of State had dismissed the appeal.

5. ENFORCEMENT ACTION

(i) "Springburn", 11 Tannage Brae, Kirriemuir

With reference to Article 2(iii) of the minute of meeting of this Committee of 2 September 1999, there was submitted Report No 336/00 by the Director of Planning and Transport detailing the circumstances relative to a recommendation to take enforcement action in relation to the colour of the roughcasting of a double garage built within the garden ground at "Springburn", 11 Tannage Brae, Kirriemuir. The Committee agreed that enforcement action be taken.

(ii) 8 Fonstane Road, Monifieth

There was submitted Report No 337/00 by the Director of Planning and Transport detailing the circumstances relative to a recommendation not to take enforcement action in respect of the erection of a trellis type fence on land to the rear of the dwellinghouse at 8 Fonstane Road, Monifieth. The Report noted that a complaint had been received regarding the erection of a fence which was over one metre in height, but within 20 metres of a road and therefore did require the benefit of planning consent. However, the Report also noted that it was likely that if an application was submitted in respect of the fence, it would attract a recommendation of approval. Government advice in such circumstances was that enforcement action should not be pursued. The Committee agreed not to take enforcement action in respect of the erection of a fence, in excess of one metre in height and within 20 metres of a road, at 8 Fonstane Road, Monifieth.

Additional Conditions:-
(i) that the number of houses be limited to one only; and
