MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 25 May 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 13 April and 4 May 2000 were submitted, approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 24 April - 12 May 2000, a total of 7 Amendments to Warrants and 66 Building Warrants had been approved with an estimated cost of £2,896,040.

3. DEVELOPMENT CONTROL COMMITTEE - SUMMER RECESS

The Committee noted that a meeting of the Development Control Committee would be held on Thursday 13 July 2000 at 6.00 pm in the Town and County Hall, Forfar.

4. ARK HILL, WIND FARM

The Committee noted that a planning application had been received in respect of a wind farm comprising 12 turbines with a total of 12 mw, a substation, control building and access track at Ark Hill, Glen Ogilvy, Forfar on behalf of RES.

The Committee was advised that the application, which was subject to an Environmental Impact Assessment, had been advertised in the local press under a number of different aspects of the planning legislation because of the issues that it potentially raised.

The Committee noted the position and that the planning application would be submitted for determination in due course.

5. PLANNING APPLICATIONS

There was submitted Report No 534/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of applications detailed in the APPENDIX to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the APPENDIX to this minute.

(iv) Withdrawn Application

The Committee agreed to note that Application No 00/00287/COU by Arbroath Sporting Club for the use of land for car boot sales on Sundays between April and November at Seaton Park, Seaton Road, Arbroath had been withdrawn.

(v) Deferred Applications

The Committee agreed to defer consideration of Application No 00/00372/FUL by Mr and Mrs Sherret for an extension to a dwellinghouse at 22 Durham Street, Monifieth and Application No 00/00288/COU by Angus Mental Health Association and Angus Independent Advocacy for the change of use from shop to office/meeting room at the former Town House, 2 Church Street, Brechin.

6. ENFORCEMENT ACTION ­ LAND AT COTSIDE QUARRY, CARNOUSTIE

There was submitted Report No 536/00 by the Director of Planning and Transport which detailed the background to an unauthorised mineral extraction at Cotside Quarry, Carnoustie and proposed that the operator be given three months to submit a valid planning application, failing which appropriate enforcement action be taken.

The Committee agreed to authorise the pursuance of enforcement action and, if appropriate, the service of a Stop Notice in respect of unauthorised mineral workings at Cotside Quarry in the event that a valid planning application was not received within three months of the date of the Report.

7. NOTIFYING APPLICANTS/OBJECTORS OF APPLICATION PROGRESS

With reference to Article 7 of the minute of meeting of this Committee of 21 October 1999, there was submitted Report No 551/00 by the Director of Planning and Transport proposing that, for a trial period, applicants and objectors be informed in advance of the intention to present planning applications to the Development Control Committee.

The Report noted that the Council, as local planning authority, was under no obligation to inform applicants or objectors when the relevant application was due to be considered by the Committee. However, one of the items in the Development Control Best Value Service Improvement Plan had been to investigate ways in which communication with applicants, agents and objectors could be improved by providing information on the progress of applications for planning permission.

The Committee therefore agreed to the introduction, on a six month trial basis, of a system of notifying applicants and objectors of applications about to be reported to Committee, the precise details of the procedure to be determined by the Director of Planning and Transport in consultation, as appropriate, with the Director of Law and Administration, and that a further report be presented at the end of the trial period.
