Development Control Committee

MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 31 August 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, DAVID LUMGAIR, The Hon R J LESLIE MELVILLE, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

Councillor McGLYNN, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 31 July ­ 18 August 2000, a total of 54 Building Warrants and 7 Amendments to Warrants had been approved with an estimated cost of £1,345,325.

2. PLANNING APPLICATIONS

There was submitted Report No 950/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the APPENDIX to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the APPENDIX to this minute.

(iv) Deferred Application

The Committee agreed to defer, at the request of the Director of Roads, Application 00/00405/FUL by D Geddes (Contractors) Ltd for the establishment of a recycling/rehandling facility within existing quarry at Waulkmill Quarry, Arbroath.

(v) Debated Application

The Committee considered Application 00/00667/FUL by Mr and Mrs Grossi for alterations and extension to house at 91 Carlogie Road, Carnoustie.

Slides were shown and the applicants' agent heard.

COUNCILLOR McGLYNN, SECONDED BY COUNCILLOR RITCHIE, MOVED THAT THE APPLICATION BE APPROVED, AS DETAILED IN THE REPORT.

Councillor West, seconded by Councillor Leslie-Melville, moved as an amendment that the application be approved, but that the condition detailed in the Report be deleted.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie, Ellis, King, Lumgair, Milne, Murphy, Roberton and Speirs (9).

For the amendment:-

Councillors Henderson, Leslie-Melville, Selfridge and West (4).

The motion was declared carried, resulting in the application being approved, subject to the condition detailed in the Report.

3. ENFORCEMENT ACTION MID ROW, NORTHMUIR, KIRRIEMUIR

There was submitted Report No 951/00 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in relation to the erection of metal pillars intended to form a security compound and the storage of vehicles, wooden pallets and lengths of metal on the forecourt of a large shed in Mid Road, Kirriemuir.

The Committee agreed to enforcement action being taken.

4. PROPOSED CERTIFICATE OF ALTERNATIVE DEVELOPMENT ON LAND AT WALMAR COTTAGE, ELLIOT, ARBROATH

There was submitted Report No 953/00 by the Director of Planning and Transport which advised that an application for a Certificate of Alternative Development for the erection of two houses, on two plots of land at Walmar Cottage, Elliot, Arbroath, had been received.

The Report indicated that the sites were affected by the proposed land take for the A92 Dundee to Arbroath dualling and this was the reason for the application having been submitted. For compensation purposes, the Committee was required to consider whether the sites would be suitable for housing development or for any other development.

The Committee agreed, under Section 25(4)(b) of the Land Compensation (Scotland) Act 1963, to issue a Certificate to the effect that planning permission would have been granted for the development for which the land was to be acquired, ie the dualling of the A92 Dundee to Arbroath road, but would not have been granted for any other development.

5. NATIONAL PLANNING POLICY GUIDELINE 6 (DRAFT REVISION) ­ RENEWAL ENERGY

With reference to Article 4 of the minute of meeting of the Planning and Transport Policy Committee of 24 August 2000, there was submitted Report No 894/00 by the Director of Planning and Transport.

The Committee, for its interest, agreed to note the terms of the draft revised NPPG at this stage.

6. ARDOWNIE QUARRY

The Committee considered a request to give an opinion in terms of the Environmental Impact Assessment (Scotland) Regulations 1999 as to whether continued quarrying operations at Ardownie Quarry, Monifieth by D Geddes (Contractors) Limited, would require the submission of an Environmental Impact Assessment.

The Committee agreed to endorse the view of the Director of Planning and Transport that an Environmental Impact Assessment was not necessary.
