MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 19 October 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE and SANDY WEST.

Apology: An apology for absence was intimated on behalf of Councillor BRIAN MILNE

Councillor McGLYNN, Convener, in the Chair.

1. BUILDING WARRANTS

The Committee noted that in the period 18 September ­ 6 October 2000, a total of 7 Amendments to Warrants and 77 Building Warrants had been approved with an estimated cost of £6,064,617.

2. PLANNING APPLICATIONS

There was submitted Report No 1198/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, and where recorded amended reasons approved by the Committee, in respect of the applications detailed in the APPENDIX to this minute.

(iii) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the APPENDIX to this minute.

(iv) Debated Application

The Committee considered Application 00/00833/FUL by Mr & Mrs M Stansfeld for the erection of garage and stores at Fortesk House, Finavon, Forfar.

Slides were shown and the local member, Councillor Stephen Leslie, addressed the Committee.

COUNCILLOR MCGLYNN, SECONDED BY COUNCILLOR RITCHIE, MOVED THAT THE APPLICATION BE APPROVED AS DETAILED IN THE REPORT.

Councillor West, seconded by Councillor Henderson, moved as an amendment, that the application be refused on the grounds that the development would have a significant adverse effect on the visual amenity of the area.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie, King, Lumgair, Murphy and Selfridge (6).

For the amendment:-

Councillors Ellis, Henderson, Leslie Melville, Roberton and West (5).

The motion was declared carried, resulting in the application being approved as detailed in the Report.

3. PLANNING APPLICATION NO 00/00405 BY G GEDDES (CONTRACTORS) LTD. - ESTABLISHMENT OF RECYCLING/REHANDLING FACILITY WITH EXISTING QUARRY, WAULKMILL, ARBROATH

With reference to Article 3(iv) of the minute of meeting of this Committee of 28 September 2000, there were submitted suitable conditions to be attached to the planning consent granted to G Geddes (Contractors) Ltd for the establishment of a recycling/rehandling facility within the existing quarry, Waulkmill, Arbroath.

The Committee agreed that the following conditions be approved and issued with a decision notice for Planning Application No 00/00405.

Conditions

  1. That prior to the commencement of development the 14 existing passing places on the section of Waulkmill Road (U474) between Boysack Mill and Bandock Farm shall be upgraded and three additional passing places shall be provided on the U474 between the site access and the Boysack Mill junction. The layout and construction specification of the upgraded and new passing places shall include kerbing, provision of a bound surface and drainage, and shall be carried out in accordance with details which shall be submitted to and approved by the Director of Planning and Transport prior to the commencement of development.
  2. That all matters regarding surface water drainage shall be to the standards required by the Scottish Environment Protection Agency to the satisfaction of the planning authority.
  3. That prior to the commencement of the development a wheel cleaning facility be provided within the site, the details of which shall be submitted to and approved by the Director of Planning and Transport.

Reasons

  1. In the interests of traffic and pedestrian safety as the existing road verges are showing signs of severe damage and distress and the existing condition and number of passing places are inadequate for the proposed use.
  2. In order to avoid pollution by ensuring that the drainage arrangements to serve the site are to the appropriate standards.
  3. In order to avoid mud etc. being carried on to the road by vehicles leaving the site.

Human Rights Implications

The conditions recommended are proportionate, balancing interference with the applicant's freedom to enjoy his property against the freedom of others to enjoy neighbouring property/home life without unjustified interference.
