MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Wednesday 20 December 2000 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, BILL ROBERTON, DAVID SELFRIDGE and RICHARD SPIERS

Apologies: Apologies for absence were intimated on behalf of Councillors PETER MURPHY and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 9 and 29 November 2000 were submitted, approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 20 November to 8 December 2000, a total of 6 Amendments to Warrants and 52 Building Warrants had been approved with an estimated cost of £1,296,504.

3. PLANNING APPLICATIONS

There was submitted Report No 1283/00 by the Director of Planning and Transport on applications for planning consent.

(i) Delegated Approvals

The Committee agreed to note consents issued by the Director of Planning and Transport as detailed in List A of the Report.

(ii) Refusals

The Committee agreed to refuse consent, for the reasons recommended by the Director of Planning and Transport, in respect of the applications detailed in the APPENDIX to this minute.

(iii) Debated Application

The Committee considered Application 00/00758/COU by Carnoustie Tyres for the change of use from vacant warehouse to Tyre, Exhaust, Battery Centre and MOT Station at 9 Ferrier Street, Carnoustie.

Slides were shown and the agent for the Applicant heard.

Councillor McGlynn, seconded by Councillor Ritchie, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR SELFRIDGE, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE APPROVED AND THAT SUITABLE CONDITIONS BE SUBMITTED TO THE COMMITTEE ON 11 JANUARY 2001 FOR CONSIDERATION.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie and Ellis (3).

For the amendment:-

Councillors Henderson, King, Leslie-Melville, Lumgair, Milne, Roberton, Selfridge and Spiers (8).

The amendment was declared carried, resulting in the application being conditionally approved with suitable conditions to be submitted to the Development Control Committee on 11 January 2001 by the Director of Planning and Transport.

(iv) Approvals

The Committee agreed to grant consent, subject to the conditions recommended by the Director of Planning and Transport, and/or where recorded any additional or amended conditions approved by the Committee, in respect of the applications detailed in the APPENDIX to this minute.

4. ENFORCEMENT APPEAL DECISION ­ LAND AT PADANARAM

With reference to Article 2(ii) of the minute of meeting of this Committee of 10 August 2000, there was submitted Report No 1288/00 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by the Scottish Ministers to determine the appeal against the service of an Enforcement Notice in respect of the unauthorised erection of stables at Padanaram.

The Committee agreed to note that the appeal had been upheld.

5. REVISION OF SECTION 75 AGREEMENT - DOBBIE'S GARDEN CENTRE, A92, MONIFIETH

With reference to Article 4 of the minute of meeting of this Committee of 4 May 2000, there was submitted Report No 1289/00 by the Director of Planning and Transport which detailed a request from Dobbie's Garden Centre for the relaxation of the Section 75 Agreement entered into when their development north of Monifieth was granted planning consent.

The Committee agreed to defer consideration of this matter to allow consultation with the Community Council and local traders to be carried out, with the outcome of the consultation to be considered along with the Report, in due course.

6. URGENT WORKS NOTICE

There was submitted Report No 1292/00 by the Director of Planning and Transport which outlined the ongoing deterioration of the Category A listed building "The Elms", Arbroath, proposed the service of an Urgent Works Notice immediately to make the building lockfast, and recommended preparatory work for service of a further Urgent Works Notice to make the building wind and watertight.

The Report noted that the ongoing deterioration of "The Elms", a Category A listed building, illustrated the need for the Council to serve Urgent Works Notices. If action was not taken to make the building wind, watertight and lockfast, an original, late Victorian interior of considerable importance would be lost completely.

The Committee therefore agreed:-

  1. to authorise the Director of Planning and Transport to immediately serve the owner of "The Elms", Cairnie Road, Arbroath with an Urgent Works Notice to make the building lockfast at an estimated cost of £2,000 and to subsequently pursue recovery of the money; with authority to enter the property, if required, and
  2. to authorise the Director of Planning and Transport to liaise with the Director of Property Services to prepare draft tender documents, specifying the works that were necessary to make "The Elms", wind and watertight in accordance with paragraph 4.3 of the Report, and to subsequently report the findings to the Committee, for consideration.

Amend Condition 3:-

That the turning circles at the end of the three cul-de-sacs off the south leg shall be formed with a minimum radius of six metres.
