MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 22 February 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

Councillor McGLYNN, Convener, in the Chair.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 20 December 2000, 11 January 2001 and 1 February 2001 were submitted, approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 26 January to 9 February 2001, a total of 49 Building Warrants had been approved with an estimated cost of £59,802.80.

3. PLANNING APPLICATIONS

(a) Delegated Approvals

There was submitted Report No 231/01 by the Director of Planning and Transport detailing the applications granted by the Director of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 24 January to 14 February 2001.

(b) Land at Ashmount, 16 Braehead Road, Letham

There was submitted Report No 232/01 by the Director of Planning and Transport detailing Application No 00/01111/COU by Mrs M Mearns for the change of use and extension of outbuildings to form a dwellinghouse on land at Ashmount, 16 Braehead Road, Letham, by Forfar. This application was recommended for approval.

Slides were shown and Mr Anderson, an objector, addressed the Committee.

The Committee agreed that the application be approved as detailed in the Report.

(c) Traill Drive, Montrose

There was submitted Report No 233/01 by the Director of Planning and Transport detailing Application No 00/01156/FUL by Montrose Links Trust for the erection of an equipment store and greens staff facilities at Traill Drive, Montrose. This application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(d) 7 Arbirlot Road, Arbroath

There was submitted Report No 235/01 by the Director of Planning and Transport detailing Application No 01/00030/FUL by Co-operative Foodstore for the installation of three automatic roller shutters at 7 Arbirlot Road, Arbroath. This application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report subject to the following additional condition:-

(2) That the shutters hereby approved are of the following design, 3 inch Aluminium Cut-out with Lexon Facility as detailed in the submitted brochure. The shutters as installed shall be of the approved design unless otherwise agreed in writing with the Director of Planning and Transport.

(e) The Gate House, Inchbare, Brechin

There was submitted Report No 236/01 by the Director of Planning and Transport detailing Application No 01/00008/FUL by R P Whelan for the erection of a timber single garage and shed (retrospective) at The Gate House, Inchbare, Brechin. This application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(f) St Malcolm's Wynd, Kirriemuir

There was submitted Report No 237/01 by the Director of Planning and Transport detailing Application No 00/01147/FUL by W H Brown Construction (Dundee) Ltd for the formation of a car park at St Malcolm's Wynd, Kirriemuir. This application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

Councillors Henderson, Leslie Melville and Selfridge left the meeting at this stage.

(g) Dronley Road, Birkhill

There was submitted Report No 234/01 by the Director of Planning and Transport detailing Application No 00/00938/REM by A & J Stephen Ltd for a residential development covering the entire site layout, means of access, landscaping, provision of open space and the erection of 35 houses on land at Dronley Road, Birkhill, Dundee. This application was recommended for approval.

Slides were shown and Mrs Irene Spence, Mr Stuart Philips, Ms Isobel Motion, Mrs Norma Chambers (all residents), Mrs Alison Hogg, Birkhill School Board and Mr T Young, Lundie, Muirhead and Liff Community Council, objectors, addressed the Committee.

Councillor McGlynn, seconded by Councillor Ritchie, moved that the application be approved as detailed in the Report, subject to the following additional condition:-

(1) That prior to the commencement of any development on site details of fencing to screen the footpath between plots 5 and 3/4 be submitted to and approved by the Director of Planning and Transport.

COUNCILLOR ELLIS, SECONDED BY COUNCILLOR KING, MOVED AS AN AMENDMENT, THAT THE APPLICATION BE REFUSED ON THE GROUNDS THAT THE ROAD LAYOUT SUBMITTED SERIOUSLY COMPROMISED ROAD AND PEDESTRIAN SAFETY AND RESIDENTIAL AMENITY.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie and West (3).

For the amendment:-

Councillors Ellis, King, Lumgair, Milne, Murphy, Roberton and Speirs (7).

The amendment was declared carried resulting in the application being refused for the reasons detailed above.

4. ANGUS DESIGN AWARDS

With reference to Article 5 of the minute of meeting of this Committee of 30 September 1999, there was submitted Report No 238/01 by the Director of Planning and Transport which outlined the successful implementation of the first Angus Design Awards Scheme.

The Report indicated that the key lesson of the Angus Design Awards Scheme was the need for partnership; in effect, recognition that good design required co-operation at all levels.

The Council had a close interest in the design of new buildings and the quality of extensions and conversions to existing buildings. Seeing over 40 designs in one room suggested that there was a wealth of architectural talent in the Angus area.

The Committee, for its interest, agreed:-

  1. to note the successful outcome of the first Angus Design Awards Scheme; and
  2. to remit to the Director of Planning and Transport to develop the scheme on a two-yearly basis with a budget of £2,000.

5. PLANNING APPEAL DECISION ­ LETHAM GRANGE (PLOT P10)

With reference to Article 2(ii) of the minute of meeting of this Committee of 13 April 2000, there was submitted Report No 239/01 by the Director of Planning and Transport which detailed the findings of the Reporter appointed by Scottish Ministers to determine the appeal against the refusal of Angus Council to grant consent for the erection of a dwellinghouse at Plot P10, Letham Grant, by Arbroath.

Committee noted that the appeal had been dismissed.

6. ENFORCEMENT ACTION ­ 4 FOUNTAINWELL SQUARE, AUCHMITHIE, BY ARBROATH

There was submitted Report No 240/01 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in respect of the erection of a satellite antenna on the front wall of a listed building within the Auchmithie Conservation Area.

Having heard the Director of Planning and Transport, the Committee noted that the satellite antenna had now been removed and that enforcement action was no longer necessary.
