MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 12 April 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE and SANDY WEST.

Apologies: Apologies for absence were intimated on behalf of Councillors JOHN HENDERSON and RICHARD SPEIRS.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 22 February and 15 March 2001 were approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 15 to 30 March 2001, a total of 9 Amendments to Warrants and 98 Building Warrants had been approved with an estimated cost of £2,407,929.00.

3. PLANNING APPLICATIONS

  1. Delegated Approvals

    There was submitted Report No 420/01 by the Director of Planning and Transport detailing the applications granted by the Director of Planning and Transport in accordance with the Scheme of Delegation detailed in Standing Orders.

    The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 7 March to 4 April 2001.

    Councillor Leslie Melville declared an interest in applications 01/00084/FUL and 01/00019/COU.

  2. Overdale, Hillside Road, Forfar

    There was submitted Report No 421/01 by the Director of Planning and Transport detailing Application No 00/00980/FUL by Mr and Mrs Main for the erection of a dwellinghouse at Overdale, Hillside Road, Forfar. This application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved as detailed in the Report.

  3. Land between 22 and 23 Golf Park Road, Brechin

    There was submitted Report No 422/01 by the Director of Planning and Transport detailing Application No 00/01056/FUL by Dawn Hooper Property Company Limited for the erection of two houses on an area of land between 22 and 23 Golf Park Road, Brechin. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  4. Tigh Na Bruaich, Ernest Street, Arbroath

    There was submitted Report No 423/01 by the Director of Planning and Transport detailing Application No 00/01150/OUT by R Spink for the outline erection of two dwellinghouses and garages at Tigh Na Bruaich, Ernest Street, Arbroath. This application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved as detailed in the Report subject to the following additional condition and reason:-

    9. That none of the existing trees within the site be felled, topped, lopped or otherwise interfered with without advance discussion with, and without the prior written consent of, the Director of Planning and Transport.

    Reason:

    9. In order that the general amenity of the area shall not be affected.

  5. Carnegie Street/Ernest Street, Arbroath

    There was submitted Report No 424/01 by the Director of Planning and Transport detailing Application No 01/00014/OUT by R Spink for the erection of two flats at Carnegie Street/Ernest Street, Arbroath. This application was recommended for approval.

    Slides were shown and Mr Burnett, an objector, addressed the Committee.

    The Committee agreed that the application be approved as detailed in the Report.

  6. 1 Dundee Road, Arbroath

    There was submitted Report No 426/01 by the Director of Planning and Transport detailing Application No 01/00128/FUL by Mr Whyte for the erection of a conservatory at 1 Dundee Road, Arbroath. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  7. Burnside, Rosemill, Bridgefoot, by Dundee

    There was submitted Report No 427/01 by the Director of Planning and Transport detailing Application No 01/00059/FUL by Mr W Milne for the erection of a double garage at Burnside, Rosemill, Bridgefoot, by Dundee. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report subject to the following additional condition and reason:-

    5. That prior to commencement of construction, the details of the access arrangements onto the public road including the position of the garage doors be submitted to and be to the satisfaction of the Director of Planning and Transport.

    Reason:

    5. In the interests of road traffic and/or pedestrian safety.

    Councillor The Hon R J Leslie Melville withdrew from the meeting, at this stage, and took no part in the discussion on the following application.

  8. Land at Caldhame Gardens, Brechin

    With reference to Article 2(I) of the minute of meeting of this Committee of 15 March 2001, there was submitted Report No 428/01 by the Director of Planning and Transport detailing Application No 01/00048/OUT by J & S Properties Limited for outline permission to erect four dwellinghouses on land at Caldhame Gardens, Brechin. This application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved as detailed in the Report.

  9. Land at Tayock Bridge, Brechin Road, Montrose

    There was submitted Report No 429/01 by the Director of Planning and Transport detailing Application No 01/00103/OUT by Montrose Auction Company Limited for outline consent to develop a 31.5 hectare site on the north side of Brechin Road, Montrose for residential purposes. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  10. Bridge of Dun, by Montrose

    There was submitted Report No 430/01 by the Director of Planning and Transport detailing Application No 01/00125/FUL by Caledonian Railway (Brechin) Limited for the erection of a temporary railway station building at Bridge of Dun, by Montrose. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  11. 112 High Street, Montrose

    There was submitted Report No 431/01 by the Director of Planning and Transport detailing Application No 01/00161/FUL by Framework Property Development Limited for the change of use of former offices to hostel at First and Second Floor level, 112 High Street, Montrose. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  12. South Union Street, Monifieth

    There was submitted Report No 432/01 by the Director of Planning and Transport detailing Application No 01/00158/FUL by T Docherty Limited for the erection of two toilet blocks at Tayview Caravan Park, South Union Street, Monifieth. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  13. Plots 49, 50 and 51 Applehill Gardens, Wellbank

    There was submitted Report No 433/01 by the Director of Planning and Transport detailing Application No 01/00822/FUL by Buddon Limited for the erection of gabion baskets at Plots 49, 50 and 51 Applehill Gardens, Wellbank. This application was recommended for approval.

    Slides were shown and the local member, Councillor Oswald, addressed the Committee.

    The Committee agreed that the application be deferred to allow the applicant to submit an engineer's report on the effectiveness of the gabion baskets.

  14. 8 Miller Street, Carnoustie

    There was submitted Report No 434/01 by the Director of Planning and Transport detailing Application No 01/00176/FUL by Mr & Mrs Haggart for an extension to a house at 8 Miller Street, Carnoustie. This application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

4. ENFORCMENT ACTION ­ GLEN DOLL

With reference to Article 5 of the minute of meeting of this Committee of 11 January 2001, the Committee noted that the unauthorised caravan sited close to the public car park at Glen Doll had now been removed from the site and that enforcement action was no longer required.
