Development Control Committee

MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 3 May 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPIERS and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 2-20 April 2001, a total of 13 Amendments to Warrants and 62 Building Warrants had been approved with an estimated cost of £1,146,060.

2. PLANNING APPLICATIONS

  1. Delegated Approvals

    There was submitted Report No 536/01 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation set out in Standing Orders.

    The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 5-25 April 2001.

  2. Plot 1, Oathlaw, by Forfar

    There was submitted Report No 537/01 by the Director of Planning and Transport detailing Application No 01/00237/FUL by Guild Homes (Tayside) Ltd for the erection of a house at Plot 1, Oathlaw, by Forfar. The application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved as detailed in the Report.

  3. Pressock Farm, Guthrie

    There was submitted Report No 538/01 by the Director of Planning and Transport detailing Application No 01/00271/FUL by John Arbuckle for the formation of a new access at Pressock Farm, Guthrie. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  4. 1A Arbirlot Road, Arbroath

    There was submitted Report No 539/01 by the Director of Planning and Transport detailing Application No 00/01135/FUL by M Macari for the installation of two ventilation ducts on the side elevation of Marcos, 1A Arbirlot Road, Arbroath. The application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved as detailed in the Report.

  5. Damside, Netherton, by Brechin

    There was submitted Report No 540/01 by the Director of Planning and Transport detailing Application No 01/00104/FUL by A Simmers for the erection of six houses at Damside, Netherton, by Brechin. The application was recommended for approval.

    Slides were shown and Mr Wilson, an objector, addressed the Committee.

    The Committee agreed that the application be approved as detailed in the Report, subject to the following additional condition:-

    (6) That development shall not begin until a scheme to deal with possible contamination on the site has been submitted to and approved in writing by the Director of Planning & Transport. The scheme shall contain details of proposals to deal with any contamination identified to include:-

    1. the nature, extent and type(s) of contamination on the site
    2. the nature, extent and type(s) of contamination on the site
    3. measures to treat/remove contamination to ensure the site is fit for the use proposed
    4. measures to deal with contamination during construction works
    5. condition of the site on completion of decontamination measures.

    Before any residential unit is occupied the measures to decontaminate the site shall be fully implemented as approved in writing by the Director of Planning & Transport.

    Reason for the condition:

    (6) In order that the Council may verify the acceptability of the proposals on health and safety grounds.

  6. Plot 3, Dundee Road, Forfar

    There was submitted Report No 541/01 by the Director of Planning and Transport detailing Application No 01/00222/FUL by Select Homes (Tayside) Ltd for the erection of a dwellinghouse at Plot 3, Dundee Road, Forfar. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

3. PLANNING APPEAL DECISION ­ TURIN HOUSE, BY FORFAR

With reference to Article 2(ii) of the minute of meeting of this Committee of 19 October 2000, there was submitted Report No 542/01 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Scottish Ministers to determine the appeal against the refusal of Angus Council to grant consent for the erection of a house at Turin House, by Forfar.

The Committee noted that Scottish Ministers had dismissed the appeal.

4. MAJOR PLANNING APPLICATION ­ ARK HILL, GLENOGILVY, FORFAR

With reference to Article 6 of the minute of meeting of this Committee of 15 March 2001, there was submitted Joint Report No 558/01 by the Director of Planning and Transport and the Director of Law and Administration which sought approval to class Application No 00/00382/FUL by Renewable Energy Systems Ltd for the erection of 12 turbines, sub-station and control building at Ark Hill, Glenogilvy, by Forfar as a major planning application.

The Report indicated that the Director of Planning and Transport was of the view that the application had major implications for Angus because it was the first such application and might therefore establish a precedent for possible future applications. It would also be visible from a significant part of Angus and a considerable number of representations had been received.

The Committee agreed:-

  1. that Application No 00/00382/FUL by Renewable Energy Systems Ltd for the erection of 12 wind turbines, sub-station and control building at Ark Hill, Glenogilvy, by Forfar be classed as a major planning application; and

  2. that the Director of Law and Administration make appropriate arrangements for a special meeting of the Development Control Committee, comprising all members of the Council, to be held on Wednesday 20 June 2001 at 6.00 pm in Forfar Academy.
