MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 9 August 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 2-27 July 2001, a total of 5 Demolition Warrants, 14 Amendments to Warrants, and 95 Building Warrants had been approved with an estimated cost of £2,274,356.

2. PLANNING APPLICATIONS

  1. Delegated Approvals

    There was submitted Report No 860/01 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

    The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 4 July ­ 1 August 2001.

  2. Tarriebank, Marywell, Arbroath

    There was submitted Report No 846/01 by the Director of Planning and Transport detailing Application No 01/00258/OUT by Tarriebank Limited for outline permission for the erection of 12 dwellinghouses on land at Tarriebank, Marywell Village, Marywell, by Arbroath.

    The Committee noted that the application had been withdrawn.

  3. 33-35 Parkview Gardens, Arbroath

    There was submitted Report No 847/01 by the Director of Planning and Transport detailing Application No 01/00646/FUL by D J Laing (Homes) Limited for the erection of fencing to the frontage of Plots 19 and 20, 33-35 Parkview Gardens, Arbroath. The application was recommended for refusal.

    Slides were shown.

    The Committee agreed that the application be refused for the reasons detailed in the Report.

  4. 32 Woodside Terrace, Carnoustie

    There was submitted Report No 852/01 by the Director of Planning and Transport detailing Application No 01/00502/COU by Mr Fyffe for the change of use of an area of open space to garden ground and the erection of a garage at 32 Woodside Terrace, Carnoustie. The application was recommended for refusal.

    The Committee agreed that the application be refused for the reasons detailed in the Report.

  5. 25 Tay Street, Monifieth

    With reference to Article 4(o) of the minute of meeting of this Committee of 12 July 2001, there was submitted Report No 842/01 by the Director of Planning and Transport detailing Application No 01/00463/FUL by Mr and Mrs Millar for the proposed alteration and extension to a dwellinghouse at 25 Tay Street, Monifieth. The application was recommended for approval.

    Slides were shown.

    The Committee agreed that the application be approved, as detailed in the Report, subject to the following condition:-

    1. That the garage hereby approved has a flat roof, details of which are to be provided for the agreement of the Director of Planning and Transport prior to commencement of construction.

    Reason:

    · In order that the amenity of nearby occupied premises shall be adequately safeguarded.

  6. 25 Provosts Walk, Monifieth

    There was submitted Report No 844/01 by the Director of Planning and Transport detailing Application No 01/00596/FUL by Mr and Mrs Ali for the extension of a dwellinghouse at 25 Provosts Walk, Monifieth. The application was recommended for approval.

    Slides were shown and Mr McGourk, an objector, was heard.

    The Committee agreed that the application be deferred to allow further consultation to take place.

  7. 78 Cortachy Crescent, Kirriemuir

    There was submitted Report No 845/01 by the Director of Planning and Transport detailing Application No 01/00640/FUL by Mr Harper and Miss Murray for the extension of a dwellinghouse at 78 Cortachy Crescent, Northmuir, Kirriemuir. The application was recommended for approval.

    Slides were shown and Mr Harper, the applicant, was heard.

    The Committee agreed that the application be approved as detailed in the Report, subject to the following amended condition:-

    1. That notwithstanding that the docqueted plan indicated a window on the south-west elevation that this window be altered or omitted to the satisfaction of the Director of Planning and Transport.

    Reason:

    · In order that the amenity of nearby occupied premises would be adequately safeguarded.

  8. Village Field, Inverkeilor, Arbroath

    There was submitted Report No 848/01 by the Director of Planning and Transport detailing Application No 01/00450/FUL by The Inverkeilor Property Co. Ltd for the erection of 15 dwellinghouses at the Village Field, Inverkeilor, Arbroath. The application was recommended for approval.

    Slides were shown and Mr Napier and Mr McDougall, objectors, were heard.

    The Committee agreed that the application be approved as detailed in the Report, subject to the following amended and additional conditions:-

    1. That prior to the commencement of construction work on the site the sewage treatment works shall be upgraded in accordance with the requirements of NoSWA to the satisfaction of the local planning authority.

    That the surface water be disposed of by means of a Sustainable Urban Drainage System, details of which are to be provided and approved by the Director of Planning and Transport prior to commencement of construction work on site.

    16. That Plots 10 and 14 be occupied by a single-storey property, details of which are to be provided for the prior approval of the Director of Planning and Transport.

    Reasons:

    15. In order that the drainage arrangements to serve the site are to the satisfaction of this Authority.

    16. In order that the amenity of nearby occupied premises shall be adequately safeguarded.

  9. Plot 7 Andson Street, Friockheim, Arbroath

    There was submitted Report No 850/01 by the Director of Planning and Transport detailing Application No 01/00496/FUL by R Dawson for the erection of a dwellinghouse and garage at Plot 7 Andson Street, Friockheim, Arbroath. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  10. Airlie Monument, Airlie Estate, Cortachy

    There was submitted Report No 851/01 by the Director of Planning and Transport detailing Application No 01/00348/FUL by Airlie Estates, Cortachy for the erection of a car park at Airlie Monument. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  11. Land at Eastfield, The Brae, Auchterhouse

    There was submitted Report No 853/01 by the Director of Planning and Transport detailing Application No 01/00342/OUT by Eastfield Estates for the erection of 16 dwellinghouses on land at Eastfield, The Brae, Auchterhouse, by Dundee. The application was recommended for approval.

    Slides were shown and Mr Bruce, an objector, and Mr Dagen, the applicant's agent, addressed the Committee.

    The Committee agreed that the application be approved as detailed in the Report and noted that a design brief would be submitted to the Director of Planning and Transport for approval.

  12. Land at 17 Wood Road, Birkhill, by Dundee

    There was submitted Report No 854/01 by the Director of Planning and Transport detailing Application No 01/00440/FUL by Mr and Mrs R Armstrong for the erection of a dwellinghouse on land at 17 Wood Road, Birkhill, by Dundee. The application was recommended for approval.

  13. Plots 49, 50 and 51 Applehill Gardens, Wellbank

    With reference to Article 3(m) of the minute of meeting of this Committee of 12 April 2001, there was submitted Report No 855/01 by the Director of Planning and Transport detailing Application No 00/00822/FUL by Buddon Ltd for the erection of gabion baskets at Plots 49, 50 and 51 Applehill Gardens, Wellbank. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report.

  14. Cunmont Quarry, by Dundee

    There was submitted Report No 856/01 by the Director of Planning and Transport detailing Application No 07/98/1001 by the James Johnston Trust for the determination of conditions under review of old minerals planning permissions of Schedule 9 of the Town and Country Planning (Scotland) Act 1997. The application was recommended for approval.

    The Committee agreed that the application be approved as detailed in the Report, subject to the following amendment to condition 3:-

    3. That ground vibration as a result of individual blasts should not exceed 12mms. Average levels should not exceed 10mms, and usually will not be below 6mms in 95% of all blasts. All blasting activities should be the subject of monitoring by the quarry operator and the results submitted in writing on a six monthly basis to the Director of Planning and Transport with the first monitoring submission being six months after the commencement of development on site.

  15. Land at Watson Street, Letham

    There was submitted Report No 859/01 by the Director of Planning and Transport detailing Application No 01/00568/OUT by Ian Robbie for the erection of two dwellinghouses on land at Watson Street, Letham. The application was recommended for approval.

    The Committee agreed that the application be deferred to allow further consultation to take place.

  16. Ardownie Quarry, by Monifieth

    With reference to Article 3(j) of the minute of meeting of this Committee of 14 June 2001, there was submitted Report No 857/01 by the Director of Planning and Transport detailing Application No 00/00731/FUL by Geddes (Contractors) Ltd for the winning and working of minerals and ancillary development at Ardownie Quarry, by Arbroath. The application was recommended for approval.

    Slides were shown and Mrs Don, an objector, and Mr Kerracher, the applicant's agent addressed the Committee.

    The Committee agreed that the application be approved as detailed in the Report, subject to the following amended condition and additional conditions:-

    6. That ground vibration as a result of individual blasts should not exceed 12mms. Average levels should not exceed 10mms, and usually will not be below 6mms in 95% of all blasts. All blasting activities should be the subject of monitoring by the applicant and the results submitted in writing on a three monthly basis to the satisfaction of the Director of Planning and Transport.

    23. That the scheme of monitoring blasting operations referred to above shall indicate the monitoring positions and the means of measurement and shall be submitted to the Director of Planning and Transport within four weeks from the date of this consent. Thereafter no blasting within any part of the quarry should be undertaken until the scheme of monitoring has been approved by the Director of Planning and Transport.

    24. That notwithstanding details submitted no blasting or rock extraction shall take place within a distance of 100 metres measured from the boundary of any residential property.

  17. Land Adjacent to Ardownie Quarry, Ardownie, by Monifieth

    With reference to Article 3(k) of the minute of meeting of this Committee of 14 June 2001, there was submitted Report No 858/01 by the Director of Planning and Transport detailing Application No D18606 by D Geddes (Contractors) Ltd for the extension of quarry operations and infilling of void with inert waste at Ardownie Quarry, Ardownie, by Monifieth. The application was recommended for refusal.

    Slides were shown and Mr Kerracher, the applicant's agent, addressed the Committee.

    In accordance with Standing Order 20(8), the Committee agreed that the meeting be continued for a period of 35 minutes.

    The Committee agreed that the application be refused for the reasons detailed in the Report.

3. PLANNING APPEAL DECISION ­ WALMAR COTTAGE, ELLIOT, ARBROATH

With reference to Article 4 of the minute of meeting of this Committee of 31 August 2001, there was submitted Report No 840/01 by the Director of Planning and Transport detailing the findings of the Reporter appointed by the Scottish Ministers to determine the appeal against the refusal of Angus Council to grant a Certificate of Appropriate Alternative Development for the erection of two houses at Walmar Cottage, Elliot, Arbroath.

The Committee noted that the Scottish Ministers had dismissed the appeal.

4. LOCATIONAL POLICY IN RESPECT OF APPLICATIONS FOR INTENSIVE LIVESTOCK BUILDINGS

In accordance with Standing Order 20(8), the Committee agreed that the meeting be continued for a period of 25 minutes.

With reference to Article 3 of the minute of meeting of this Committee of 12 July 2001, there was submitted Report No 841/01 by the Director of Planning and Transport detailing the proposed policy in respect of the location of intensive livestock buildings in relation to protected buildings which would primarily be residential properties.

After hearing Councillor Myles, Mr Mitchell and Mr Ogg, the Committee agreed to defer the policy for further consideration.
