MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 8 November 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, DAVID SELFRIDGE and RICHARD SPEIRS.

Apologies: Apologies for absence were intimated on behalf of Councillors BILL ROBERTON and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 27 September and 18 October 2001 were approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 8 ­ 26 October 2001, a total of 1 Demolition Warrant, 4 Amendments to Warrants and 65 Building Warrants had been approved with an estimated cost of £3,292,335.

3. PLANNING APPLICATIONS

(a) Delegated Approvals

There was submitted Report No 1258/01 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 11-31 October 2001.

(b) Mill of Brighty Farm, Gagie, by Dundee

There was submitted Report No 1259/01 by the Director of Planning and Transport detailing Application No 01/00812/FUL by Mr Bruce Robertson for the erection of a dwellinghouse at Mill of Brighty Farm, Gagie, by Dundee. The application was recommended for refusal.

Slides were shown and Mr Robertson, the applicant, addressed the meeting.

Councillor McGlynn, seconded by Councillor Ritchie, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR ELLIS, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE DEFERRED TO ALLOW THE APPLICANT TO REVISE THE PLANS IN CONSULTATION WITH THE DIRECTOR OF PLANNING AND TRANSPORT.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie, Milne and Selfridge (4).

For the amendment:-

Councillors Ellis, Henderson, King, Leslie Melville, Lumgair, Murphy and Speirs (7).

The amendment was declared carried resulting in the application being deferred.

(c) Viewbank House, Weavers Walk, Forfar

There was submitted Report No 1260/01 by the Director of Planning and Transport detailing Application No 01/00886/FUL by J Richardson for the outline erection of a dwellinghouse on land at Viewbank House, Weavers Walk, Forfar.

The Committee noted that the application had been withdrawn.

(d) 13 Broomfield Road, Montrose

There was submitted Report No 1261/01 by the Director of Planning and Transport detailing Application No 01/00843/OUT by Mrs E Fitchett for the outline erection of a dwellinghouse at 13 Broomfield Road, Montrose. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

Councillor Selfridge declared an interest in the following item and took no part in the decision.

(e) Land Adjacent to Panbride Farm, Panbride, Carnoustie

There was submitted Report No 1262/01 by the Director of Planning and Transport detailing Application No 01/00712/FUL by Martin Alan Construction Ltd for the erection of 18 houses on land adjacent to Panbride Farm, Panbride, Carnoustie. The application was recommended for approval.

Slides were shown.

The Committee agreed that the application be approved as detailed in the Report.

(f) Broomhill Drive, Monifieth

There was submitted Report No 1263/01 by the Director of Planning and Transport detailing Application No 01/00873/FUL by Bett Homes Limited for the erection of 52 dwellinghouses at Broomhill Drive, Monifieth. The application was recommended for approval.

Slides were shown.

The Committee agreed that the application be approved as detailed in the Report subject to the following additional condition:-

14 That none of the existing trees within the site be felled, topped, lopped or otherwise interfered with without advance discussion with and without the prior written consent of the Director of Planning and Transport.

Reason:

14 In order that the general amenity of the area shall not be affected.

(g) 4 The Fairway, Monifeith

With reference to Article 4(d) of the minute of meeting of this Committee of 12 July 2001, there was submitted Report No 1264/01 by the Director of Planning and Transport detailing Application No 01/00968/FUL by Mr Culross for the erection of a house at No 4 The Fairway, Monifieth, Dundee. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(h) 168 Coupar Angus Road, Birkhill

There was submitted Report No 1265/01 by the Director of Planning and Transport detailing Application No 01/00882/FUL by Mr and Mrs D Russell for the extension of a house at 168 Coupar Angus Road, Birkhill, Dundee. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(i) The Cottage, 2 Edward Place, Muirhead, By Dundee

There was submitted Report No 1266/01 by the Director of Planning and Transport detailing Application No 01/00929/FUL by S McIntyre for the extension of The Cottage, Muirhead, by Dundee. The application was recommended for approval.

Slides were shown and Mrs Wilson, an objector, addressed the meeting.

The Committee agreed that the application be approved as detailed in the Report but that the applicant be asked to consider amending the roof type to satisfy the objector's concerns.

(j) 11 Gardyne Street, Letham

With reference to Article 2(k) of the minute of meeting of this Committee of 18 October 2001, there was submitted Report No 1267/01 by the Director of Planning and Transport detailing Application No 01/00788/FUL by B Litterick for the demolition of existing house and erection of a dwellinghouse at 11 Gardyne Street, Letham.

The Committee noted that the application had been deferred.

4. REVIEW OF BUILDING CONTROL IN SCOTLAND

With reference to Article 7 of the minute of meeting of this Committee of 4 May 2000, there was submitted Report No 1268/01 by the Director of Planning and Transport which detailed a suggested response to the Scottish Executive Consultation Paper on the Review of Building Control in Scotland, which included proposals for the improvement and reform of the Building Standards System (Part Three: Next Steps).

The Report noted that the proposals contained in the Report "Improving Building Standards" had many positive aspects which would strengthen the role of building control. Some aspects, unless they were robustly defined and controlled, could cause problems. More onus was to be placed on the adoption of best practice, best value and competency of local authorities in providing building control services. Given the latest statutory performance indicators, the advanced implementation of the Best Value Service Review in relation to Building Control and the investment in training, Angus Council was well placed to tackle the issues raised in the Report.

The Committee agreed to note the proposals of the Scottish Executive for the Review of Building Control in Scotland, and to submit the Report, including detailed comments on key issues identified in Appendix 1 (Part 3, Question 23), as the Council's formal response to the consultation paper.
