MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 29 November 2001 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON and RICHARD SPEIRS.

Apologies: Apologies for absence were intimated on behalf of Councillors DAVID SELFRIDGE and SANDY WEST.

1. BUILDING WARRANTS

The Committee noted that in the period 29 October ­ 16 November 2001, a total of 1 Staged Warrant, 15 Amendments to Warrants and 70 Building Warrants had been approved with an estimated cost of £6,635,40.00.

2. 2002/03 REVENUE BUDGET

With reference to Article 3 of the minute of meeting of the Planning and Transport Policy Committee of 22 November 2001, there was submitted Report No 1334/01 by the Director of Finance advising the Committee of the latest position with regard to the preparation of the Planning and Transport Department 2002/03 revenue budget and associated issues. Appended to the Report was a summary of the departmental provisional base budget for 2002/03 as submitted to, and subsequently reviewed by, the Director of Finance.

The Committee agreed:-

  1. to note the contents of the Report for its interest at this stage in the budget process; and
  2. to note that more detailed Reports with specific recommendations would be submitted later in the revenue budget cycle.

3. 2001/2005 FINANCIAL PLAN AND 2002/03 CAPITAL BUDGET

With reference to Article 4 of the minute of meeting of the Planning and Transport Policy Committee of 22 November 2001, there was submitted Report No 1335/01 by the Director of Finance which detailed the latest position with regard to the preparation of the 2001/05 Financial Plan (incorporating the 2002/03 capital budget) for the Planning and Transport Department. Appended to the Report were the departmental Financial Plan submissions for 2001/2005 as returned to the Director of Finance and subsequently reviewed by the Capital Budget Sub Group.

The Committee agreed:-

  1. to note the contents of the Report for its interest at this stage in the Financial Plan process; and
  2. to note that more detailed Reports with specific recommendations would be submitted later in the budget cycle.

4. SECTION 75 AGREEMENT ­ BALKELLO LANDFILL SITE

The Committee considered a request for the issue of a final Certificate of Completion for restoration works undertaken at Balkello landfill site as part of the Restoration Bond Agreement, which accompanied Planning application No D19211 for infilling of inert waste material at Balkello, Auchterhouse, by Dundee.

The Committee agreed:-

  1. that the Restoration Bond be returned to the applicant and a Completion Certificate issued; and
  2. that Clauses First, Third, Fourth, Fifth, Seventh, Eighth, Ninth, Tenth and Eleventh of the Section 75 Agreement (previously Section 50) be discharged as they were no longer relevant as the development had ceased.

5. PLANNING APPLICATIONS

(a) 11 Gardyne Street, Letham

With reference to Article 3(j) of the minute of meeting of this Committee of 8 November 2001, the Committee agreed to note that Application No 01/00788/FUL by B Litterick for the demolition of existing house and erection of a dwellinghouse at 11 Gardyne Street, Letham, had been withdrawn by the applicant.

(b) Delegated Approvals

There was submitted Report No 1396/01 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 1 November to 21 November 2001.

(c) 12 St James Road, Forfar

There was submitted Report No 1398/01 by the Director of Planning and Transport detailing Application No 01/00783/COU by Mrs M Morrison for the conversion of an outbuilding to a dwellinghouse at 12 St James Road, Forfar. The application was recommended for refusal.

The Committee agreed that the application be refused for the reasons detailed in the Report.

(d) 63 Viewmount, Forfar

There was submitted Report No 1399/01 by the Director of Planning and Transport detailing Application No 01/00949/FUL by A Stephen for the erection of a dwellinghouse at 63 Viewmount, Forfar. The application was recommended for refusal.

Slides were shown and Mr Stephen, the applicant, addressed the meeting.

Councillor McGlynn, seconded by Councillor Ritchie, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR ROBERTON, SECONDED BY COUNCILLOR LESLIE MELVILLE, MOVED AS AN AMENDMENT THAT THE APPLICATION BE APPROVED SUBJECT TO THE FOLLOWING CONDITION:

1. That the roof covering and wall finish match the existing building.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie, King, Lumgair and Milne (5).

For the amendment:-

Councillors Ellis, Henderson, Leslie-Melville, Murphy, Roberton and Speirs (6).

The amendment was declared carried resulting in the application being approved subject to the condition detailed above.

(e) Quarry Park Cottage, Balgavies

There was submitted Report No 1400/01 by the Director of Planning and Transport detailing Application No 01/00967/LBC by Mr C Gunn for listed building consent for replacement windows (retrospective) at Quarry Park Cottage, Balgavies, Forfar. The application was recommended for refusal.

The Committee agreed that the application be refused for the reasons detailed in the Report.

(f) The Dower House, West Balruddery, Invergowrie

There was submitted Report No 1401/01 by the Director of Planning and Transport detailing Application No 01/00657/FUL by Mr and Mrs B Cruickshank for the erection of a dwellinghouse at The Dower House, West Balruddery, Invergowrie, by Dundee. The application was recommended for refusal.

Slides were shown and Mr Cruickshank, the applicant, addressed the meeting.

Councillor McGlynn, seconded by Councillor Ritchie, moved that the application be refused for the reasons detailed in the Report.

COUNCILLOR ELLIS, SECONDED BY COUNCILLOR KING, MOVED AS AN AMENDMENT THAT THE APPLICATION BE APPROVED SUBJECT TO CONDITIONS BEING SUBMITTED AND APPROVED BY THE COMMITTEE AND THE APPLICANT SUBMITTING A COMPREHENSIVE TREE PLANTING SCHEME TO THE SATISFACTION OF THE DIRECTOR OF PLANNING AND TRANSPORT.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ritchie, Murphy and Speirs (4).

For the amendment:-

Councillors Ellis, Henderson, King, Leslie-Melville, Lumgair, Milne and Roberton (7).

The amendment was declared carried resulting in the application being approved.

(g) 42 Brothock Way, Arbroath

There was submitted Report No 1403/01 by the Director of Planning and Transport detailing Application No 01/00942/FUL by Mr Rennie for the erection of a conservatory at 42 Brothock Way, Arbroath. The application was recommended for refusal.

The Committee agreed that the application be refused for the reasons detailed in the Report.

Councillor Ritchie left the meeting at this stage.

(h) 126-128 High Street, Carnoustie

There was submitted Report No 1405/01 by the Director of Planning and Transport detailing Application No 01/00955/COU by M Fagan and G Esposito for the change of use of a storage building to a licensed restaurant and take-away at 126-128 High Street, Carnoustie. The application was recommended for approval.

Slides were shown and Mr Glenday, an objector, and Mr Lean, the applicant's agent, addressed the meeting.

COUNCILLOR MCGLYNN, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE APPROVED AS DETAILED IN THE REPORT.

Councillor Murphy, seconded by Councillor Speirs, moved, as an amendment, that the application be refused as the proposal was contrary to Policy H21 of the Local Plan.

On a vote being taken, the members voted:

For the motion:-

Councillors McGlynn, Ellis, Henderson, King, Lumgair, Milne and Roberton (7).

For the amendment:-

Councillors Leslie-Melville, Murphy and Speirs (3).

The motion was declared carried resulting in the application being approved subject to the following amended condition:-

2. That a scheme for the control of litter including receptacles for the deposit of litter be agreed with the Director of Planning and Transport and be implemented prior to the use commencing.

Reason:

2. In order that the general amenity of the area shall not be affected.

(i) Burnside of Kirkbuddo, Kirkbuddo, by Forfar

There was submitted Report No 1406/01 by the Director of Planning and Transport detailing Application No 01/00956/FUL by W Todd & Sons for the conversion of a store to a dwellinghouse at Burnside of Kirkbuddo, by Forfar. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(j) Land at Dundee Road, Forfar

There was submitted Report No 1407/01 by the Director of Planning and Transport detailing Application No 01/00714/OUT by Webster Contracts Ltd for the erection of six dwellinghouses on land at Dundee Road, Forfar. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(k) 5 Warslap Avenue, Arbroath

There was submitted Report No 1408/01 by the Director of Planning and Transport detailing Application No 01/00822/FUL by Mr and Mrs Watt for the extension of a dwellinghouse at 5 Warslap Avenue, Arbroath. The application was recommended for approval.

Slides were shown and Monica Barber, an objector, addressed the meeting.

The Committee agreed that the application be approved as detailed in the Report.

(l) Site 2, Chapel Street, Forfar

There was submitted Report No 1410/01 by the Director of Planning and Transport detailing Application No 01/00874/FUL by Angus Housing Association for the erection of four dwellinghouses and two flats with associated parking at Site 2, Chapel Street, Forfar. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(m) Land at Rosehill Road/Broomfield Road, Montrose

There was submitted Report No 1411/01 by the Director of Planning and Transport detailing Application No 01/00920/FUL by W W Pert & Co Ltd for the erection of three dwellinghouses at Rosehill Road/Broomfield Road, Montrose. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(n) Land at Dubton Station, Montrose

There was submitted Report No 1413/01 by the Director of Planning and Transport detailing Application No 01/00834/FUL by Miss Fiona McIntosh for the erection of a dwellinghouse and garage on land at Dubton Station, Montrose. The application was recommended for approval.

COUNCILLOR MCGLYNN, SECONDED BY COUNCILLOR KING, MOVED THAT THE APPLICATION BE APPROVED AS DETAILED IN THE REPORT.

Councillor Henderson, seconded by Councillor Murphy, moved as an amendment that the application be refused as the application was in breach of four policies within the Angus Local Plan.

On a vote being taken, the members voted:

For the motion:-

Councillors McGlynn, Ellis, King, Leslie-Melville, Milne, Roberton and Speirs (7).

For the amendment:-

Councillors Henderson, Lumgair and Murphy. (3).

The motion was declared carried subject to the following additional condition:-

7. That prior to the commencement of development detailed plans shall be provided indicating proposed floor and ground levels and any underbuilding requirements relative to the existing ground level of the site for the written approval of the Director of Planning and Transport.

Reason:

7. In order that the Council may verify the acceptability of the proposals on amenity grounds. (541)

(o) The Bungalow, Dundee Road, Forfar

There was submitted Report No 1414/01 by the Director of Planning and Transport detailing Application No 01/00921/OUT by Mr H Gillies for the outline erection of a dwellinghouse on land at The Bungalow, Dundee Road, Forfar. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

6. ENVIRONMENTAL IMPROVEMENTS AT EITHIE HAVEN/CORBIE KNOWE

With reference to Article 2 of the minute of meeting of this Committee of 5 December 1996, there was submitted Report No 1417/01 by the Director of Planning and Transport detailing a request for grant aid to place underground an intrusive overhead electricity cable on headland at Ethie Haven/Corbie Knowe.

The Report indicated that officials would have preferred at the time of the original application for the line to have been placed underground, but this was financially unviable. However, the Corbie Knowe property owners had now raised the necessary funding for the Committee to achieve the original objective in 1996.

The Committee agreed that, as the Angus coastline would be significantly enhanced, a contribution of £2,500 be made to the Keillor Trust from the Conservation Grants budget towards the undergrounding of overhead cables and poles situated on headland between Ethie Haven/Corbie Knowe.

7. DEVELOPMENT CONTROL COMMITTEE ­ NEXT MEETING

The Committee agreed to note that a meeting of the Development Control Committee would be held on Thursday 20 December 2001 at 6.00pm in the Town and County Hall, Forfar.
