MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 10 January 2002 at 6.05 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, ALEX KING, The Hon R J LESLIE MELVILLE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

Apologies: Apologies for absence were intimated on behalf of Councillors DAVID LUMGAIR and BRIAN MILNE.

1. BUILDING WARRANTS

The Committee noted that in the period 10-28 December 2001, a total of 1 Staged Warrant, 2 Demolition Warrants, 7 Amendments to Warrants and 79 Building Warrants had been approved with an estimated cost of £2,859,403.

2. PLANNING APPLICATIONS

(a) Delegated Approvals

There was submitted Report No 32/02 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 13 December 2001 ­ 3 January 2002.

(b) Land at Old West Manse, Main Street, Barry

There was submitted Report No 33/02 by the Director of Planning and Transport detailing application No 01/00931/OUT by Premier Developments Ltd for the erection of five houses on land at Old West Manse, Main Street, Barry and planning and listed building consent applications 01/00932/FUL and 01/00933/LBC for the conversion of the Old West Manse, Main Street, Barry to form four dwelling units. The applications were recommended for conditional approval, subject to the applicant signing Section 75 Agreements.

Slides were shown and Mr Sherman and Mr Speirs, objectors, addressed the meeting.

The Committee agreed that the applications be approved as detailed in the Report, subject to the following amended condition in respect of Application 01/00931/OUT:-

2 That prior to the commencement of development the existing access shall be upgraded to the standards required by Angus Council which shall include the formation of a bellmouth of throat width 5.5 metres with 6 metre kerb radii at its junction with Main Street, all formed and constructed in accordance with the standards of Angus Council.

(c) Land Adjacent to 7 North Nevay Cottages, Eassie, by Forfar

There was submitted Report No 34/02 by the Director of Planning and Transport detailing application No 01/01092/OUT by Mr and Mrs K Durstan for the erection of two houses on land adjacent to 7 North Nevay Cottages, Eassie. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(d) Land to the West of Innervar, Panmure Road, Monikie

With reference to Article 18 of the minute of meeting of this Committee of 20 December 2001, there was submitted Report No 35/02 by the Director of Planning and Transport detailing application No 01/00793/OUT by I G C MacDonald & Co for the erection of a Scout Hut facility on land to the west of Innervar, Panmure Road, Monikie. The application was recommended for approval.

Slides were shown and Councillor Oswald, the local member, addressed the meeting.

The Committee agreed that the application be approved as detailed in the Report.

(e) Land at Merpro Ltd, Brent Avenue, Montrose

There was submitted Report No 36/02 by the Director of Planning and Transport detailing application No 01/01160/TEL by Orange Personal Communications Services Ltd for the erection of a 20 metre telecommunications mast antenna, associated equipment cabinets at ground level, compound fence and other equipment on land at Merpro Ltd, Brent Avenue, Montrose. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(f) Land at Chapelton, Arbroath

There was submitted Report No 37/02 by the Director of Planning and Transport detailing application No 01/01121/FUL by Brian Soutar for the erection of a dwellinghouse on land at Chapelton, Arbroath. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(g) Site Adjacent to Slatefield, Dundee Road, Forfar

There was submitted Report No 38/02 by the Director of Planning and Transport detailing application No 01/01176/OUT by Select Homes (Tayside) Ltd for the erection of three dwellinghouses on a site adjacent to Slatefield, Dundee Road, Forfar. The application was recommended for approval, subject to the applicant signing a Section 75 Agreement.

The Committee agreed that the application be approved as detailed in the Report.

(h) Land at Slatefield Farm, Dundee Road, Forfar

There was submitted Report No 39/02 by the Director of Planning and Transport detailing application No 01/01188/OUT by Select Homes (Tayside) Ltd for the erection of ten houses and associated roads on land at Slatefield Farm, Dundee Road, Forfar. The application was recommended for approval, subject to the applicant signing a Section 75 Agreement.

The Committee agreed that the application be approved as detailed in the Report.

(i) Berryhill Farm and Binns of Fowlis, Fowlis, Invergowrie

There was submitted Report No 42/02 by the Director of Planning and Transport detailing the undernoted nine applications by Mr I Moncrieff at the linked farms of Berryhill and Binns of Fowlis:

01/01130 For the conversion and extension of existing cottages at Berryhill Farm to form one dwellinghouse.

01/01131 Listed building consent for the above.

01/01137 * Detailed approval for a replacement farmhouse and farm buildings on land at Berryhill Farm.

01/01138 For the alteration, extension, etc including part demolition of the existing steading complex at Berryhill Farm to form eight houses together with the erection of a further three dwellinghouses.

01/01139 Listed building consent for the above.

01/01140 For the demolition of an existing house at Berryhill Farm to be replaced by a new house.

01/01141 * Outline consent for the erection of a stockman's cottage at Binns of Fowlis Farm.

01/01142 Erection of a barn at Binns of Fowlis Farm.

01/01143 * Outline consent for the demolition of the existing farmhouse at Binns of Fowlis and its replacement with a new farmhouse.

The applications were recommended for approval subject to the applicant signing a Section 75 Agreement in respect of those marked with an asterisk.
