MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 31 January 2002 at 6.00 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, ALEX KING, The Hon R J LESLIE MELVILLE, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

Apology: An apology for absence was submitted on behalf of Councillor JOHN HENDERSON.

1. BUILDING WARRANTS

The Committee noted that in the period 31 December 2001-18 January 2002, a total of 1 Demolition Warrant, 8 Amendments to Warrants and 49 Building Warrants had been approved with an estimated cost of £2,214,883.

2. PLANNING APPLICATIONS

(a) Delegated Approvals

There was submitted Report No 182/02 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

The Committee agreed to note applications, detailed in the Appendix to the Report, granted under delegated powers during the period 4 January-23 January 2002.

(b) Chapel Works, Marine Avenue, Montrose

There was submitted Report No 165/02 by the Director of Planning and Transport detailing application No 01/01008/FUL by Prime (UK) Developments Limited for the erection of a Primary Care Centre on the eastern half of the former Chapel Works, Marine Avenue, Montrose, along with an associated listed building consent application 01/01009/LBC to alter a listed warehouse on the western boundary of the site and a Conservation Area Consent application 01/01062/CON to demolish unlisted buildings on the southern part of the site. The applications were inter-related and were recommended for approval subject to conditions.

Slides were shown and Mr Chumbley, the applicant's representative, addressed the meeting.

The Committee agreed that the applications be approved as detailed in the Report.

(c) 12-14 Nursery Road, Montrose

There was submitted Report No 166/02 by the Director of Planning and Transport detailing application No 01/01212/FUL by J Henderson for the erection of two dwellinghouses at 12-14 Nursery Road, Montrose. The application was recommended for conditional approval.

The Committee agreed that the application be approved as detailed in the Report,

(d) Land at Birns Farm Cottage, West Skichen, Carmyllie, Arbroath

There was submitted Report No 167/02 by the Director of Planning and Transport detailing application No 01/01190/OUT by Brunton Design Studio for the outline erection of a dwellinghouse on land at Birns Farm Cottage, West Skichen, Carmyllie, Arbroath. The application was recommended for conditional approval.

The Committee agreed that the application be approved as detailed in the Report,

(e) No 33 Holdings, Tealing, by Dundee

There was submitted Report No 168/02 by the Director of Planning and Transport detailing application No 01/00868/OUT by D Burns for the outline erection of a dwellinghouse at No 33 Holdings, Tealing, by Dundee. The application was recommended for approval.

Slides were shown and Mr Burns, the objector, addressed the meeting.

The Committee agreed that the application be approved as detailed in the Report.

(f) Plots 1-12 Piperdam (Phase 2), Fowlis, Dundee

There was submitted Report No 169/02 by the Director of Planning and Transport detailing application No 01/00936/REM by Kirkwood Homes for the erection of 12 dwellinghouses at Plots 1-12 Piperdam (Phase 2), Fowlis, Dundee. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(g) 2 Cunmont Farm Cottages, Monifieth

There was submitted Report No 170/02 by the Director of Planning and Transport detailing application No 01/01155/FUL by Mr and Mrs Wilson for the extension of a dwellinghouse at 2 Cunmont Farm Cottages, Monifieth. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(h) 19 Hill Terrace, Birkhill

There was submitted Report No 171/02 by the Director of Planning and Transport detailing application No 01/01267/FUL by Terry Barber for the erection of a dwellinghouse on land at 19 Hill Terrace, Birkhill, Dundee. The application was recommended for conditional approval.

The Committee agreed that the application be approved as detailed in the Report.

(i) Land at 32 Redford Road, Padanaram

There was submitted Report No 172/02 by the Director of Planning and Transport detailing application No 01/01185/OUT by R Reeves for the erection of a dwellinghouse on land at 32 Redford Road, Padanaram. The application was recommended for conditional approval.

The Committee agreed that the application be approved as detailed in the Report.

(j) 28 Cortachy Crescent, Kirriemuir

There was submitted Report No 173/02 by the Director of Planning and Transport detailing application No 01/01119/FUL by Mr and Mrs A Milne for the extension of a dwellinghouse at 28 Cortachy Crescent, Kirriemuir. The application was recommended for conditional approval.

The Committee agreed that the application be approved as detailed in the Report.

(k) 29-35 Seagate, Arbroath

There was submitted Report No 174/02 by the Director of Planning and Transport detailing application Nos 01//00962/CON and 01/00934/FUL by Seagate Point Ltd for the demolition of the existing buildings and erection of 14 seafront apartments at 29-35 Seagate, Arbroath. Both applications were recommended for conditional approval.

Slides were shown and Mr Joe Dagen, the agent for 31 objectors; Mr D Smith, Mr Millar and Mrs McHendry's representative, also objectors; and Mr Heinz Voigt, the applicant's architect; all addressed the meeting.

COUNCILLOR MCGLYNN, SECONDED BY COUNCILLOR ELLIS MOVED THAT THE APPLICATIONS BE APPROVED AS DETAILED IN THE REPORT.

Councillor King, seconded by Councillor Ritchie moved as an amendment that Application No 01/00962/CON for the demolition of the existing buildings be approved and that Application No 01/00934/FUL for the erection of 14 seafront apartments be refused on the grounds that the proposal was an over intensive development for the area.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Ellis, Leslie-Melville, Milne, Selfridge and West (6)

For the amendment:-

Councillors Ritchie, King, Lumgair, Murphy, Roberton and Spiers (6).

There being an equality of votes, the Convener exercised his casting vote in favour of the motion, which was declared carried, resulting in the applications being approved as detailed in the Report.

(l) Land at Rear of 11 Park Avenue, Carnoustie

There was submitted Report No 176/02 by the Director of Planning and Transport detailing application No 01/01192/FUL by A Neal for the erection of a double garage on land to the rear of 11 Park Avenue, Carnoustie. The application was recommended for refusal.

The Committee agreed that the application be refused for the reasons detailed in the Report.

(m) Land at 9 William Street, Carnoustie

There was submitted Report No 177/02 by the Director of Planning and Transport detailing application No 01/01136/FUL by Mrs C Robertson for the erection of a single house on land at 9 William Street, Carnoustie. The application was recommended for conditional approval.

3. ENFORCEMENT ACTION ­ LUMLEY DEN COTTAGE, TEALING

There was submitted Report No 178/02 by the Director of Planning and Transport which detailed the circumstances relative to a recommendation to take enforcement action in respect of the unauthorised construction of an extension which had been built onto the rear of the dwellinghouse known as Lumley Den Cottage, Tealing.

The Committee agreed that enforcement action be taken as detailed in the Report.

4. NORTH OF SCOTLAND WATER AUTHORITY

With reference to Article 6 of the minute of meeting of the Planning and Transport Policy Committee of 24 January 2002, there was submitted Report No 90/02 by the Director of Planning and Transport which outlined the Indicative Needs Profile 2001-10 (Angus) prepared by NoSWA which would guide investment for water and drainage projects in the Angus area by Scottish Water, the future Water Authority covering Scotland. The Report also reviewed the opportunity to amend the existing formal drainage constraints affecting Letham, Muirhead and Birkhill, Forfar and Carnoustie.

The Committee, for its interest, agreed to approve the recommendations, as detailed in the Report.

5. EXCLUSION OF PUBLIC AND PRESS

The Committee resolved, in terms of Standing Order 27(2) that the public and press be excluded during consideration of the following item, so as to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, paragraphs 4, 6 and 8.

6. UNCOMPLETED BUILDING WORKS AT 8 GUTHRIE STREET, FRIOCKHEIM

With reference to Article 2 of the minute of the special meeting of this Committee of 11 January 2001, there was submitted Report No 179/02 by the Director of Planning and Transport which updated members on the current position of the uncompleted works at 8 Guthrie Street, Friockheim.

The members noted the schedule of works which had been submitted and agreed that a progress Report be presented to the next meeting of the Committee.
