MINUTE of MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 11 July 2002 at 6.00pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, JOHN HENDERSON, DAVID LUMGAIR, BRIAN MILNE, PETER MURPHY, BILL ROBERTON and DAVID SELFRIDGE.

Apologies: Apologies for absence were intimated on behalf of Councillors ALEX KING, The Hon R J LESLIE MELVILLE, RICHARD SPEIRS and SANDY WEST.

1. MINUTES OF PREVIOUS MEETINGS

The minutes of meetings of this Committee of 30 May and 20 June 2002 were approved as correct records and signed by the Convener.

2. BUILDING WARRANTS

The Committee noted that in the period 10-28 June 2002, a total of 7 Amendments to Warrants and 120 Building Warrants had been approved with an estimated cost of £2,299,054.

3. PLANNING APPLICATIONS

(a) Delegated Approvals

There was submitted Report No 836/02 by the Director of Planning and Transport detailing the applications granted by him in accordance with the Scheme of Delegation appended to Standing Orders.

The Committee agreed to note the applications, detailed in the Appendix to the Report, granted under delegated powers during the period 13 June-3 July 2002.

(b) Tarriebank, Marywell, Arbroath

There was submitted Report No 837/02 by the Director of Planning and Transport detailing application No 02/00291/OUT by Tarriebank Ltd for an outline residential development on land at Tarriebank, Marywell Village, Arbroath. The application was recommended for refusal.

Slides were shown and Mr Coutts, the applicant's agent, addressed the meeting

COUNCILLOR McGLYNN, SECONDED BY COUNCILLOR RITCHIE, MOVED THAT THE APPLICATION BE REFUSED FOR THE REASONS DETAILED IN THE REPORT.

Councillor Milne, seconded by Councillor Ellis, moved, as an amendment, that the application be approved subject to the Director of Planning and Transport placing suitable conditions on the application.

Councillor Milne advised that his reason for moving approval contrary to Development Plan policy was that there would be substantial planning gain from the application being granted in terms of improved road safety and a precedent had already been set in that planning consent existed for five houses.

On a vote being taken, the members voted:-

For the motion:-

Councillors McGlynn, Henderson, Murphy, Roberton and Selfridge (6).

For the amendment:-

Councillor Ellis, Lumgair and Milne (3).

The motion was declared carried resulting in the application being refused for the reasons detailed in the Report.

(c) Land at Rear of 11 Park Avenue, Carnoustie

Councillors Murphy and Selfridge declared an interest in this application and left the meeting while it was being considered.

There was submitted Report No 838/02 by the Director of Planning and Transport detailing application No 02/00549/FUL by B Boyd for the erection of two garages on land to the rear of 11 Park Avenue, Carnoustie. The application was recommended for refusal.

Slides were shown and Mr Brunton, the applicant's agent, addressed the meeting.

The Committee agreed that the application be refused for the reasons detailed in the Report.

(d) 10 Gallowden Avenue, Arbroath

There was submitted Report No 839/02 by the Director of Planning and Transport detailing application No 02/00458/FUL by Mrs Murphy for the extension to a dwellinghouse at 10 Gallowden Avenue, Arbroath. The application was recommended for refusal.

The Committee agreed that the application be refused for the reasons detailed in the Report.

Councillor Henderson left the meeting at this stage.

(e) O'Hara's Bar, 41 West High Street, Forfar

There was submitted Report No 840/02 by the Director of Planning and Transport detailing application Nos 02/00371/FUL and 02/00372/LBC by Mr S Baxter for the siting of three tables on the pavement and the replacement of external lights at O'Hara's Bar, 41 West High Street, Forfar.

The Committee noted that the applicant had withdrawn the application.

(f) The Bungalow, Dundee Road, Forfar

There was submitted Report No 841/02 by the Director of Planning and Transport detailing application No 02/00418/FUL by H Gillan for the erection of a dwellinghouse on land at The Bungalow, Dundee Road, Forfar.

The Committee noted that the applicant had withdrawn the application.

(g) Land at Meikle Coull Farm, Tannadice, Forfar

There was submitted Report No 842/02 by the Director of Planning and Tranport detailing application No 02/00580/OUT by Graeme Farquharson for the outline erection of a dwellinghouse on land at Meikle Coull Farm, Tannadice, Forfar.

The Committee noted that the applicant had withdrawn the application.

(h) Land at Backmuir of Liff

There was submitted Report No 843/02 by the Director of Planning and Transport detailing application No 02/00477/OUT by Mr G Curr for the outline erection of a dwellinghouse on land at Backmuir of Liff, Dundee. The application was recommended for refusal.

(i) Land at Old Smiddy, Dronley

There was submitted Report No 844/02 by the Director of Planning and Transport detailing application No 02/00410/FUL by Mr B Robertson for the erection of a dwellinghouse on land at the Old Smiddy, Dronley, Dundee. The application was recommended for refusal.

There was submitted Report No 845/02 by the Director of Planning and Transport detailing application No 02/00474/OUT by Mr Naseem for the erection of a dwellinghouse and garage on land at the rear of 13-25 Fisheracre, Arbroath. The application was recommended for refusal.

There was submitted Report No 846/02 by the Director of Planning and Transport detailing application No 01/00207/OUT by Mr Stewart for the erection of a single house at Wood of Aldbar, by Brechin.

The Committee noted that the applicant had withdrawn the application.

(m) Land at Elliot, Arbroath

There was submitted Report No 847/02 by the Director of Planning and Transport detailing application No 02/00040/OUT by G Land for a residential development on land at Elliot, Arbroath. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(n) Elliot Caravan Park, Elliot, Arbroath

There was submitted Report No 848/02 by the Director of Planning and Transport detailing application No 02/00341/COU by R S Cargill for the change of use of land to form an extension to an existing caravan park at Elliot Caravan Park, Elliot, Arbroath. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(o) 7 Tommy Armour Place, Carnoustie

There was submitted Report No 849/02 by the Director of Planning and Transport detailing application No 02/00461/FUL by Mr Louden for alterations to a dwellinghouse at 7 Tommy Armour Place, Carnoustie. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(p) Land to North-East of River South Esk, Glen Clova

There was submitted Report No 850/02 by the Director of Planning and Transport detailing application No 00/01092/FUL by H Niven for the formation of a reservoir on land to north-east of River South Esk, Glen Clova. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(q) 84 Murray Street, Montrose

There was submitted Report No 851/02 by the Director of Planning and Transport detailing application No 02/00427/FUL by I Mayse for replacement windows at 84 Murray Street, Montrose. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report subject to the following condition:

1. That precise details of the style of window to be utilised be submitted to and approved by the Director of Planning and Transport prior to installation.

Reason:

1. In order that the Council may verify the acceptability of the proposals on amenity grounds.

(r) 24B Montrose Road, Forfar

There was submitted Report No 852/02 by the Director of Planning and Transport detailing application No 02/00509/COU by G McFarlane for the change of use of a ground floor flat into office accommodation at 24B Montrose Road, Forfar. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(s) Rosewood Cottage, Dumbarrow Bridge, Forfar

Councillor Roberton declared an interest in this application and left the meeting while it was being considered.

There was submitted Report No 853/02 by the Director of Planning and Transport detailing application No 02/00570/FUL by Mr and Mrs K Isaacs for the extension of a dwellinghouse at Rosewood Cottage, Dumbarrow Bridge, Forfar. The application was recommended for approval.

(t) Ark Hill, Glenogilvy, Glamis, Forfar

There was submitted Report No 854/02 by the Director of Planning and Transport detailing application No 02/00571/FUL by Renewable Energy Systems Ltd for the erection of a 50 metre high temporary anemometer for a period of two years at Ark Hill, Glenogilvy, Glamis. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(u) 9 High Street, Arbroath

There was submitted Report No 855/02 by the Director of Planning and Transport detailing application No 02/00469/FUL by J Stewart for the extension to shop to form café area at 9 High Street, Arbroath. The application was recommended for approval.

The Committee agreed that the application be approved as detailed in the Report.

(v) Cotside Quarry, Barry

There was submitted Report No 856/02 by the Director of Planning and Transport detailing application No 02/00243/FUL by Wm. Clark for the continuation of sand and gravel extraction and processing and ancillary development, including site restoration proposals, at Cotside Quarry, Barry. The application was recommended for approval, subject to a Section 75 Agreement.

The Committee agreed that the application be approved subject to a Section 75 Agreement and the conditions detailed in Report 856/02; and to the following additional clause in the Agreement and amended conditions:-

Clause 2: That within 12 months of the date of this permission all scrap or unused vehicles, plant and machinery shall be removed from the site to the written satisfaction of the Director of Planning and Transport.

Conditions:

11. That no development shall take place in Area G until a scheme to screen the quarry workings from the A930 public road has been agreed in writing and implemented to the written satisfaction of the Director of Planning & Transport. The agreed scheme shall include the retention of the banking from the north east corner of the stand of trees within Area B to the 15 metre contour in the southern section of Area G and shall prevent any extraction beyond the 15 metre contour in a southerly direction.

13. That a stand-off area of 20 metres (top of working face) from the site boundary to the adjacent gas pipeline shall be maintained at all times within which there shall be no quarrying activity unless it can be demonstrated to the satisfaction of the Director of Planning & Transport that public safety will not be adversely affected.

18. That within six months of the date of this permission the bagged storage area shall be set back a distance of 55 metres from the A930 public road unless otherwise agreed in writing with the Director of Planning & Transport. The existing storage area within 55 metres of the public road to be returned to agricultural use or an alternative agreed use within 10 months of the date of this permission.

Reason:

In the interests of visual amenity.

(w) Land at Inchock Cottage, Inverkeilor, Arbroath

There was submitted Report No 857/02 by the Director of Planning and Transport detailing application No 02/00344/OUT by Mr and Mrs Stephen for the outline erection of a dwellinghouse on land at Inchock Cottage, Inverkeilor, Arbroath. The application was recommended for approval.

(x) 142 Montrose Street, Brechin

There was submitted Report No 858/02 by the Director of Planning and Transport detailing application No 02/00630/FUL by R Hutchison for alterations to a dwellinghouse at 142 Montrose Street, Brechin. The application was recommended for approval.
