Special Meeting of the Development Control Committee

MINUTE of SPECIAL MEETING of the DEVELOPMENT CONTROL COMMITTEE held in the Town and County Hall, Forfar on Thursday 10 January 2002 at 5.30 pm.

Present: Councillors STEWART McGLYNN, KITTY RITCHIE, FRANK ELLIS, ALEX KING, The Hon R J LESLIE MELVILLE, PETER MURPHY, BILL ROBERTON, DAVID SELFRIDGE, RICHARD SPEIRS and SANDY WEST.

Apologies: Apologies for absence were intimated on behalf of Councillors DAVID LUMGAIR, BRIAN MILNE and JOHN HENDERSON.

1. EXCLUSION OF PUBLIC AND PRESS

The Committee resolved, in terms of Standing Order 27(2), that the public and press be excluded during consideration of the following item, so as to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973 Paragraphs 4, 6 and 8.

2. UNCOMPLETED BUILDING WORKS AT 8 GUTHRIE STREET, FRIOCKHEIM

With reference to Article 8 of the minute of meeting of this Committee of 20 December 2001, the Committee convened as a hearing in terms of the Building (Scotland) Act 1959. In this connection, there was submitted Joint Report No 73/02 by the Director of Law and Administration and the Director of Planning and Transport which detailed the current circumstances in respect of an unfinished house extension at 8 Guthrie Street, Friockheim and asked the Committee to consider whether or not the Council should resolve to make an Order under Section 10 of the Building (Scotland) Act 1959 as amended.

Slides were shown, following which Mr Reen, the property owner's agent, addressed the Committee on the various issues highlighted in the Report and answered members' questions.

After a full discussion, the Committee agreed:-

  1. to make an Order under Section 10 of the Building (Scotland) Act 1959 as amended requiring completion of the works specified in Appendix A to Report 73/02;
  2. to instruct the Director of Law and Administration to defer serving the Order on the owner to enable him to submit to the Director of Planning and Transport a schedule of works and timetable for completion, within the next three weeks;
  3. to ask the Director of Planning and Transport to submit a further Report to the meeting of this Committee on 31 January 2002 explaining what progress had been made; and
  4. to warn the owner of the consequences of any failure to comply with the Committee's requirements.
