APPENDIX III to the minute of the meeting of the Education Committee of 21 January 1997 (Article 6(c) refers)

MINUTE of MEETING of the ATTENDANCE SUB-COMMITTEE of the EDUCATION COMMITTEE held in the Town House, Montrose on Thursday 16 January 1997 at 9.45 am.

Present: Councillors BRIAN MILNE, SANDY WEST and Mrs JACQUELINE SIM and Mrs EILEEN CAMERON.

Apology: An apology for absence was intimated on behalf of Councillor RICHARD SPEIRS.

1. EXCLUSION OF PUBLIC AND PRESS

The Sub-Committee resolved in terms of Standing Order No 27(2) that the public and press be excluded during consideration of Item 2 below to avoid the disclosure of information which was exempt in terms of Part I of Schedule 7A to the Local Government (Scotland) Act 1973, (paragraph 5).

2. EDUCATION (SCOTLAND) ACT 1980 - ATTENDANCE DEFAULT

The Sub-Committee considered the cases of 3 children who had failed to attend school regularly without a reasonable excuse. Appropriate notice had been served on their parents requiring them to appear before or give written information to this meeting.:-

Case No 1/97

The parent failed to appear or give written information and, after consideration, the Sub-Committee agreed that the parent be prosecuted in terms of Section 43 of the Education (Scotland) Act 1980 for an offence under Section 35 of that Act and that the pupil be referred to the Reporter to the Children's Panel.

Case No 2/97

Having heard the parent, the Sub-Committee agreed to give the parent a warning and continue the case for six weeks to allow an improvement in attendance.

Case No 3/97

Having noted that the parent had not received notice of this meeting, the Sub-Committee agreed that consideration of this case be deferred to allow further attempts to be made to serve notice on the parent.
