MINUTE of MEETING of the SCHOOL ATTENDANCE SUB-COMMITTEE of the EDUCATION COMMITTEE held in the Community Wing, Arbroath Academy, Arbroath on Thursday 17 December 1998 at 10.15 am.

Present: Councillors BRIAN M C MILNE, Mrs KATHLEEN RITCHIE and GEORGE NORRIE; and Mr EDWARD SIMPSON and Mr RON MURRAY.

1. MINUTE OF PREVIOUS MEETING

The minute of meeting of this Sub-Committee of 6 November 1998 was submitted and approved as a correct record and signed by the Convener.

2. EXCLUSION OF PUBLIC AND PRESS

The Sub-Committee resolved, in terms of Standing Order No 27(2), that the public and press be excluded during consideration of the following item so as to avoid the possible disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, paragraph 5.

3. EDUCATION (SCOTLAND) 1980 - ATTENDANCE DEFAULT CASE NO 2/98

With reference to Article 2 of the minute of meeting of the Sub-Committee of 6 November 1998, the Sub-Committee considered the case of a child who had failed to attend school regularly without reasonable excuse. Appropriate notice had been served on the child’s parents requiring them to appear or give written information to this meeting. The child’s mother was present at the meeting.

The Sub-Committee heard the school representative give details on the pupil’s non-attendance, following which members sought answers to a number of questions from the child’s mother. The school representative and the mother then withdrew from the meeting.

After consideration, the Sub-Committee agreed:

(i) that the child’s parent had failed to satisfy them that he had a reasonable excuse for failing to attend school regularly; and

(ii) accordingly, that a prosecution be instructed forthwith under Section 43 of the Education (Scotland) Act 1980.
