APPENDIX II to the minute of meeting of the Education Committee of 16 October 2001 (Article 2(c) refers)

MINUTE of MEETING of the SPECIAL CASES SUB-COMMITTEE of the EDUCATION COMMITTEE held in the Meeting Room, 7 The Cross, Forfar on Thursday 27 September 2001 at 11.00 am.

Present: Councillors BRIAN MILNE, SHEENA WELSH and DAVID LUMGAIR.

1. MINUTE OF PREVIOUS MEETING

There was submitted and approved as a correct record the minute of meeting of this Sub-Committee of 22 March 1999.

2. EXCLUSION OF PUBLIC AND PRESS

The Sub-Committee resolved, in terms of Standing Order 27(2), that the public and press be excluded during consideration of the following item, so as to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, paragraph 1.

3. VETTING OF SCHOOL CONVEYANCE CONTRACT ESCORT

Case No 1/01

There was submitted Joint Report No 1095/01 by the Director of Law and Administration, the Director of Education and the Director of Planning and Transport informing the Sub-Committee of their decision to refuse an accredited Escort Pass in respect of a school conveyance contract following consideration of information from the Scottish Criminal Records Office relating to the applicant. In accordance with the Council's procedure, an appeal had been lodged by the applicant.

The Sub-Committee was advised of the existence of a spent conviction and agreed that justice could not be done without sight of it. Accordingly, information about the spent conviction was circulated to the Sub-Committee.

The applicant, together with her friend, and the Director of Education's representative, were admitted to the meeting in order to present their respective cases in person.

All parties in attendance heard the Director of Education's representative explain the reasons for the decision to refuse to grant the Pass and answered general questions. Thereafter, the applicant presented her case, explaining the circumstances of her two current convictions and her spent conviction, following which she answered general questions. Each party summed up their cases and then withdrew from the meeting.

Following detailed consideration of the submissions, the Sub-Committee unanimously agreed that the grounds of appeal had been substantiated and accordingly that it be upheld, and that an accredited Escort Pass be issued.
