APPENDIX I to the minute of meeting of the Education Committee of 27 August 2002 (Article 1(b) refers)

MINUTE of MEETING of the SPECIAL CASES SUB-COMMITTEE of the EDUCATION COMMITTEE held in the Meeting Room, 7 The Cross, Forfar on Thursday 15 August 2002 and Tuesday 20 August 2002 at 3.00 pm.

Present: Councillors BRIAN MILNE, SHEENA WELSH and DAVID LUMGAIR.

Councillor MILNE, Convener, in the Chair.

1. MINUTE OF PREVIOUS MEETING

There was submitted and approved as a correct record the minute of meeting of this Sub-Committee of 30 April 2002.

2. EXCLUSION OF PUBLIC AND PRESS

The Sub-Committee resolved, in terms of Standing Order 27(2) that the public and press be excluded during consideration of the following item, so as to avoid the disclosure of information which was exempt in terms Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, paragraph 1.

3. VETTING OF SCHOOL CONVEYANCE CONTRACT ESCORT

Case No 1/02

There was submitted Joint Report No 625/02 by the Director of Law and Administration, the Director of Education and the Director of Planning and Transport informing the Sub-Committee of their decision to refuse an accredited driver's pass in respect of a school conveyance contract following consideration of information from the Scottish Criminal Records Office relating to the applicant. In accordance with the Council's procedure, an appeal had been lodged by the applicant.

The applicant's representative and the Director of Education were admitted to the meeting in order to present their respective cases in person.

All parties in attendance heard the Director of Education explain the reasons for the decision to refuse to grant the pass and answered general questions. Thereafter, the applicant's representative presented the applicant's case, following which he answered general questions. Each party summed up their cases and then withdrew from the meeting.

Following detailed consideration of the submissions, the Sub-Committee unanimously agreed that proceedings be adjourned as it was satisfied that further information was required in relation to the applicant's case and that the applicant should attend in person.

In accordance with procedure, and appropriate notice having been given, the Sub-Committee reconvened on Tuesday 20 August 2002 at 3.00 pm.

The applicant was admitted to the meeting to present his case in person and the Sub-Committee heard him explain the circumstances relating to his two current convictions. Thereafter the applicant summed up his case and withdrew from the meeting.

Following consideration of the submissions, the Sub-Committee unanimously agreed that the grounds of the appeal had been substantiated, and accordingly that it be upheld, and that an accredited driver's pass be issued.
