APPENDIX I to the minute of meeting of the Personnel and Property Services Committee of 13 March 2001 (Article 17(b) refers)>

MINUTE of MEETING of the EXECUTIVE SUB- COMMITTEE of the PERSONNEL AND PROPERTY SERVICES COMMITTEE held in the Town and County Hall, Forfar on Thursday 15 February 2001 at 11.00 am.>

Present: >Councillors BILL MIDDLETON, ROB MURRAY and GEORGE NORRIE MBE (substitute for Peter Murphy).>

Apology:> An apology for absence was intimated on behalf of Councillor PETER MURPHY.>

1. EXCLUSION OF PUBLIC AND PRESS>

The Sub-Committee resolved, in terms of Standing Order 27(2), that the public and press be excluded from the meeting during consideration of the following items, so as to avoid the disclosure of information which was exempt in terms of Part 1 of Schedule 7A to the Local Government (Scotland) Act 1973, Paragraphs 6, 8 and 9.>

2. TERM CONTRACT FOR URGENT REPAIRS AND JOBBING CONTRACTS ­ MAINTENANCE OF PROPERTIES (EXCLUDING COUNCIL HOUSING) 2001/2004>

With reference to Article 2 of the minute of meeting of the Personnel and Property Services Committee of 28 November 2000, there was submitted Report No 122/01 by the Director of Property Services advising the Sub-Committee that, following advertisement, a number of firms had expressed an interest in tendering for the various trades associated with the term contract for urgent repair and jobbing contracts in respect of maintenance of properties (excluding Council housing) for the period 1 April 2001 to 31 March 2004.>

The Sub-Committee agreed:->

(i) to approve the placing of orders, in the most advantageous manner, with the contractors for each trade and area as identified in Appendix A to the Report, for the period 1 April 2001 to 31 March 2004;>

(ii) to authorise the Director of Property Services to negotiate with and appoint contractors from other contract areas where a deficiency of contractors arose in a given trade and area due to circumstances outwith the control of the Council and also to authorise the Director of Property Services, where appropriate, to recover all additional costs incurred as a result of such action from any defaulting contractor who had contributed towards such a deficiency, on the understanding that the outcome of all such negotiations were subsequently reported to the Personnel and Property Services Committee; and>

(iii) to note that the maximum value of any individual order issued by the Director of Property Services would be restricted to £5,000.>

3. ALTERATIONS AND EXTENSION TO ABERLEMNO PRIMARY SCHOOL ­ TENDER REPORT>

With reference to Article 7 of the minute of meeting of the Personnel and Property Services Committee of 13 June 2000, there was submitted Report No 123/01 by the Director of Property Services containing details of tenders received for the design and construction of a single-storey classroom extension block, together with alteration works at Aberlemno Primary School.>

The Sub-Committee agreed:->

(i) to approve acceptance of the lowest tender submitted for the several works, that of Muirfield (Contracts) Ltd, Dundee in the amount of £246,273.30, subject to the implementation of savings amounting to £6,500;>

(ii) to approve the estimated total cost of £269,750 after implementation of savings in respect of this project (at out-turn prices); and>

(iii) to note that an allowance of £260,000 had been made for this project in the Property Renewal and Repair Fund, supplemented by other funding sources and that the additional provision required would be met from the Education Department's Revenue Budget and the Property Renewal and Repair Fund.>

4. FORFAR ACADEMY CURTAIN WALLING ­ TENDER REPORT>

With reference to Article 2(a) of the minute of meeting of the Personnel and Property Services Committee of 30 January 2001, the Sub-Committee agreed to defer consideration of this item.>

5. J & G CONSTRUCTION LIMITED ­ INSOLVENCY>

There was submitted Report No 205/01 by the Director of Property Services advising the Committee that J & G Construction Ltd, Dundee were now insolvent and that all works on Council projects being undertaken by them had now ceased.>

The Sub-Committee, for its interest, agreed:->

(i) to note the current situation;>

(ii) to note that J & G Construction Ltd, Dundee had ceased work on all Council projects as of 19 January 2001 and that a liquidator had been appointed on 22 January 2001;>

(iii) to note the Council properties which were affected and the responsive action taken by the Director of Property Services; and>

(iv) to approve the actions proposed to complete the works by authorising the Director of Property Services and the Director of Finance to place completion contracts at the earliest opportunity, in consultation with the Conveners of the appropriate Committees and the Convener of the Personnel and Property Services Committee, for subsequent homologation by the relevant Committees.>
